00HOUSE BILL NO. 393 01 "An Act providing for an annual land lottery." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 38.05.057(a) is amended to read: 04  (a) The commissioner may dispose of land, including land limited to use for 05 agricultural purposes, by lottery. The commissioner shall offer at least 25,000 acres 06 of land, in parcels of at least five and not more than 80 acres, by lottery each 07 year. The purchase price of land sold by lottery shall be the fair market value of the 08 land as determined by the commissioner. The commissioner may sell land by lottery 09 for less than the fair market value of the land on a determination that scarcity of land 10 for private use in the area of the land to be sold has resulted in unrealistic land values. 11 The lottery shall be conducted in public by the commissioner. A purchaser selected 12 by lot shall deposit an amount equal to five percent of the purchase price within 30 13 days after receiving notification of the selection and shall reimburse the state for the 14 cost of surveying the parcel .

01 * Sec. 2. AS 38.05.057 is amended by adding new subsections to read: 02  (k) The commissioner shall publish an informational pamphlet describing each 03 parcel to be offered under (a) of this section at least 45 days before the date of the 04 lottery. The pamphlet must include information about access to the parcel, 05 transportation, and available utilities. 06  (l) Disposal of a parcel of land under this section does not obligate the state 07 or a municipal government to make any improvements to the existing infrastructure 08 serving the parcel. Notwithstanding any other provision of state law, state funds may 09 be used to construct a new school building primarily serving parcels disposed of under 10 this section only if there are at least 20 students to be served.
