00HOUSE BILL NO. 379 01 "An Act relating to credited service under the public employees' retirement system 02 for peace officers and fire fighters on leave without pay or receiving workers' 03 compensation benefits because of certain on-the-job injuries." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 39.35.160(a) is amended to read: 06  (a) Except as provided in (d) of this section, beginning [BEGINNING] 07 January 1, 1987, each peace officer or fire fighter shall contribute to the system an 08 amount equal to seven and one-half percent of the peace officer's or fire fighter's 09 compensation. Beginning January 1, 1987, each other employee shall contribute to the 10 system an amount equal to six and three-quarters percent of the employee's 11 compensation. The contributions shall be deducted by the employer at the end of each 12 payroll period. The contributions shall be deducted from employee compensation 13 before computation of applicable federal taxes, and the contributions shall be treated 14 as employer contributions under 26 U.S.C. 414(h)(2).

01 * Sec. 2. AS 39.35.160 is amended by adding a new subsection to read: 02  (d) The employer of a peace officer or fire fighter who is physically injured 03 while on the job and who, as a result of the physical injury, is placed on leave- 04 without-pay status or is receiving benefits under AS 23.30, shall pay the member's 05 contributions under this section while the member is, as a result of the on-the-job injury, on 06 leave-without-pay status or receiving the benefits under AS 23.30. 07 * Sec. 3. AS 39.35.330 is amended by adding a new subsection to read: 08  (d) A peace officer or fire fighter who is physically injured while on the job 09 and who, as a result of the physical injury, is placed on leave-without-pay status, 10 whether or not the employee receives workers' compensation benefits under AS 23.30 11 for the injury, is entitled to accrue credited service while the employee, because of the 12 injury, is on leave-without-pay status. Entitlement to credited service under this 13 subsection ends when the employee is eligible to receive benefits under 14 AS 39.35.370(a) or 39.35.410(a). 15 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section 16 to read: 17 APPLICABILITY. This Act entitles a peace officer or fire fighter who is an employee 18 under AS 39.35 to receive credited service for days on leave without pay or days when the 19 peace officer or fire fighter was receiving workers' compensation benefits under AS 23.30 that 20 occur on or after the effective date of this Act.
