00CS FOR HOUSE BILL NO. 284(JUD) am                                                                                     
01 "An Act relating to uninsured and underinsured motor vehicle insurance; and                                             
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 28.20.445(f) is amended to read:                                                                  
05  (f)  If both the owner and operator of the uninsured vehicle are unknown,                                             
06 payment under the uninsured and underinsured motorists coverage shall be made only                                      
07 where direct physical contact between the insured and uninsured or underinsured motor                                   
08 vehicles has occurred , or where the accident is witnessed by a person not occupying                                   
09 the insured vehicle who will attest to the facts of the accident and the involvement                                    
10 of a motor vehicle that left the accident scene without being identified .  A vehicle                                  
11 that has left the scene of the accident with an insured vehicle is presumed to be                                       
12 uninsured if the person insured reports the accident to the appropriate authorities within                              
13 24 hours.                                                                                                               
14    * Sec. 2.  AS 28.22.201(b) is amended to read:                                                                     

01  (b)  If both the owner and operator of a vehicle are unknown, payment under                                           
02 the uninsured and underinsured motorists coverage may be made only where direct                                         
03 contact between the motor vehicles has occurred , or where the accident is witnessed                                   
04 by a person not occupying the insured vehicle who will attest to the facts of the                                       
05 accident and the involvement of a motor vehicle that left the accident scene                                            
06 without being identified .  A vehicle and operator that have left the scene of an                                      
07 accident with another vehicle are presumed to be uninsured if the insured person                                        
08 reports the accident to the appropriate authorities within 24 hours.                                                    
09    * Sec. 3.  This Act takes effect January 1, 2001.
