00CS FOR HOUSE BILL NO. 284(L&C)                                                                                        
01 "An Act relating to uninsured and underinsured motor vehicle insurance."                                                
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
03    * Section 1.  AS 28.20.445(f) is amended to read:                                                                  
04  (f)  If both the owner and operator of the uninsured vehicle are unknown,                                             
05 payment under the uninsured and underinsured motorists coverage shall be made only                                      
06 where direct physical contact between the insured and uninsured or underinsured motor                                   
07 vehicles has occurred , or where the accident is witnessed by a disinterested person                                   
08 not occupying the insured vehicle who will attest to the facts of the accident and                                      
09 the involvement of a motor vehicle that left the accident scene without being                                           
10 identified .  A vehicle that has left the scene of the accident with an insured vehicle                                
11 is presumed to be uninsured if the person insured reports the accident to the                                           
12 appropriate authorities within 24 hours.                                                                                
13    * Sec. 2.  AS 28.22.201(b) is amended to read:                                                                     
14  (b)  If both the owner and operator of a vehicle are unknown, payment under                                           

01 the uninsured and underinsured motorists coverage may be made only where direct                                         
02 contact between the motor vehicles has occurred , or where the accident is witnessed                                   
03 by a disinterested person not occupying the insured vehicle who will attest to the                                      
04 facts of the accident and the involvement of a motor vehicle that left the accident                                     
05 scene without being identified .  A vehicle and operator that have left the scene of an                                
06 accident with another vehicle are presumed to be uninsured if the insured person                                        
07 reports the accident to the appropriate authorities within 24 hours.
