00HOUSE BILL NO. 253 01 "An Act establishing a school disciplinary and safety program; and providing for 02 an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.33 is amended by adding a new section to read: 05 Article 2. Required School Disciplinary and Safety Program. 06  Sec. 14.33.100. Required disciplinary and safety program. (a) Each 07 governing body shall adopt a written district student disciplinary and safety program. 08 A disciplinary and safety program adopted by a governing body must include the 09 following: 10  (1) conflict resolution procedures; 11  (2) standards for student behavior; in developing the student behavior 12 standards, the governing body shall use a process that allows for community 13 suggestions, review, and revision of the standards; 14  (3) procedures to notify teachers of dangerous students consistent with

01 AS 47.12.310(b); 02  (4) policies for maintaining a safe school environment conducive to 03 learning; 04  (5) policies for removing or suspending a student for disruptive 05 behavior or behavior described under AS 14.30.045(1) or (2); 06  (6) procedures for enforcing school discipline; and 07  (7) disaster and emergency procedures. 08  (b) A governing body shall give each teacher authority to suspend a student 09 for up to one day for disruptive behavior or for behavior described under 10 AS 14.30.045(1) or (2). 11  (c) If the same student is suspended more than three times in a semester, the 12 school principal shall create a discipline team that includes the student's teacher, the 13 student's parent or guardian, a school counselor, a district counselor or psychologist, 14 the school principal or the principal's designee, a representative of the school's parent- 15 teacher association, and the student. The discipline team shall design a behavioral intervention 16 plan to reduce the student's disruptive behavior. The student's teacher and the school 17 principal shall jointly monitor the plan, and a plan may be modified if the student displays 18 continuing disruptive behavior. A student participating in a discipline plan may nevertheless 19 be removed or suspended from school. 20  (d) A principal or other school official who 21  (1) receives information about a student under AS 47.12.310(b) or (c) 22 that may affect the safety of students or staff shall notify the student's teacher and 23 school administrator; and 24  (2) observes a student committing a crime shall report the crime to the 25 local law enforcement agency; in this paragraph, "crime" has the meaning given in 26 AS 11.81.900. 27 * Sec. 2. TRANSITION. A school district or a regional educational attendance area shall 28 adopt the initial student disciplinary and safety program required by AS 14.33.100, enacted 29 in sec. 1 of this Act, by January 1, 2000. 30 * Sec. 3. This Act takes effect July 1, 1999.
