00CS FOR HOUSE BILL NO. 113(HES) 01 "An Act relating to the age for attending public school; and relating to a 02 program of postsecondary education for secondary school students." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.03.070 is amended to read: 05  Sec. 14.03.070. School age. Except as provided in AS 14.03.080(b), a 06 person [A CHILD] who is six years of age before August 15 following the beginning 07 of the school year, or [AND] who [IS UNDER THE AGE OF 20 AND] has not 08 completed the 12th grade, is of school age. 09 * Sec. 2. AS 14.03.080(b) is repealed and reenacted to read: 10  (b) A person who is 20 years of age or older may be admitted to the public 11 school in the school district of which the person is a resident only if the governing 12 body determines, consistent with 42 U.S.C. 12101-12213 (Americans with Disabilities 13 Act of 1990), that the person has the mental, physical, and emotional capacity to 14 perform satisfactorily for the educational program being offered.

01 * Sec. 3. AS 14.30 is amended by adding new sections to read: 02 Article 10. Postsecondary Enrollment Options Program. 03  Sec. 14.30.760. Postsecondary enrollment program. (a) A student enrolled 04 in a secondary school in a school district or otherwise receiving a secondary school 05 education as described in AS 14.30.010(b)(1) or (10) - (12) and who is under 20 years 06 of age may also apply for enrollment in courses at a state-operated postsecondary 07 institution. If a postsecondary institution accepts a secondary school student, the 08 institution shall send written notice to the student, the student's school district, and the 09 department within 10 days after acceptance. The notice must include the student's 10 courses and hours of enrollment. 11  (b) A school district shall make counseling services regarding the risks and 12 possible consequences of enrolling in postsecondary courses available to students and 13 a student's parents or guardian. Upon request, the department shall provide assistance 14 to a school district in developing counseling programs. 15  (c) A student may not enroll in postsecondary courses under this section if the 16 same class is offered by the secondary school or by arrangement with a postsecondary 17 institution at the student's secondary school. A student who has graduated from high 18 school may not participate in the postsecondary program established under this section, 19 but a student who has completed course requirements for graduation but has not 20 received a diploma may participate. 21  (d) Students who have graduated from high school may receive enrollment 22 priority over secondary school students in a postsecondary institution. A 23 postsecondary institution may provide program information but may not recruit or 24 solicit secondary school student participation. A governing body may not prohibit a 25 secondary school student from participating in extracurricular activities if the 26 prohibition results from enrollment in a postsecondary course as described under this 27 section. 28  Sec. 14.30.770. Calculation of academic credit. (a) A student who enrolls 29 in and successfully completes a postsecondary course shall receive secondary school 30 credit as provided under (b) of this section and postsecondary school credit as provided 31 by the postsecondary institution.

01  (b) The department shall determine the secondary school academic credit to 02 be granted to a student who successfully completes a postsecondary course. As 03 determined by the department, a governing body shall grant academic credit towards 04 graduation requirements and subject area requirements. The completion of a 05 postsecondary course must be included in the student's academic record. 06  (c) A postsecondary institution may not charge a tuition fee for the award of 07 credit described in this section. 08  Sec. 14.30.780. Funding for postsecondary institutions. (a) Subject to 09 appropriation, the district shall pay the tuition costs of postsecondary courses taken for 10 secondary school credit. The district may not make payments for a course from which 11 a student withdraws during the first 14 days of the quarter or semester. 12  (b) A postsecondary institution operated by the state that enrolls a secondary 13 school student shall receive the amount agreed to between the governing body of that 14 district and the postsecondary institution. 15  (c) The district shall pay the amounts described under (b) of this section within 16 30 days after receiving initial enrollment information for each quarter or semester. 17 Any changes in enrollment information shall be reported by the postsecondary 18 institution at the time for reporting enrollment information in the following quarter or 19 semester. If the district determines that an overpayment has occurred, the institution 20 shall promptly remit the amount overpaid to the district. 21  Sec. 14.30.790. Prohibited financial aid and fees. (a) A secondary school 22 student may not receive a student loan under AS 14.43 while enrolled in a 23 postsecondary course for secondary school credit. 24  (b) A postsecondary institution that receives payment under AS 14.30.780 may, 25 under an agreement with the district, charge a student for course specific fees and for 26 support services directly related to the course taken by the student. 27  Sec. 14.30.799. Definitions. In AS 14.30.760 - 14.30.799, 28  (1) "district" has the meaning given in AS 14.17.990; 29  (2) "postsecondary institution" means a regionally accredited school, 30 college, or university operated by the state primarily offering academic, vocational, or 31 technical education to a person who has completed secondary school.
