00HOUSE BILL NO. 7 01 "An Act relating to motor vehicle registration plates." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 28.10.051(a) is amended to read: 04  (a) The department may suspend or revoke the registration of a vehicle, the 05 certificate of registration or registration plates for a vehicle, or a special permit when 06  (1) the department determines that the registration or certificate, plate, 07 or permit was fraudulently procured or erroneously issued; 08  (2) the department determines that a registered vehicle is mechanically 09 unsafe to be driven or moved on a highway, vehicular way or area, or other public 10 property in this state and the vehicle has been seized or impounded under 11 AS 28.05.091; 12  (3) a registered vehicle has been scrapped, dismantled, or destroyed 13 beyond repair; 14  (4) the department determines that a required fee or tax has not been

01 paid and the fee or tax is not paid upon reasonable notice and demand; 02  (5) a registration plate, permit, or certificate is knowingly displayed 03 upon a vehicle other than the vehicle for which issued or approved ; 04  (6) the department determines that the owner of a vehicle has 05 committed an offense under this chapter involving the registration or the certificate, 06 plate, or permit to be suspended or revoked; 07  (7) the vehicle has been reported to the department as stolen or 08 unlawfully converted; 09  (8) the department is otherwise required to do so under the laws of this 10 state; 11  (9) the department determines that the vehicle owner has violated the 12 requirements of AS 28.10.146 or 28.10.147; 13  (10) the department determines that a repair to a commercial motor 14 vehicle, ordered by the Department of Transportation and Public Facilities or the 15 Department of Public Safety under regulations adopted under AS 19, was not 16 completed after the owner or operator represented to the Department of Transportation 17 and Public Facilities, the Department of Public Safety, or the Department of 18 Administration that the repair had been completed; or 19  (11) the owner or operator of a commercial motor vehicle has placed 20 a commercial motor vehicle back in service after it has been placed out of service by 21 the Department of Transportation and Public Facilities or the Department of Public 22 Safety without having it reinspected as required under regulations adopted under 23 AS 19. 24 * Sec. 2. AS 28.10.091 is amended to read: 25  Sec. 28.10.091. Lost or mutilated certificates of registration or registration 26 plates. If a certificate of registration or a registration plate is lost, stolen, mutilated, 27 or becomes illegible, the owner or legal representative or successor in interest of the 28 owner of the vehicle for which the certificate or plate was issued or approved as 29 shown by the records of the department shall, immediately upon discovering the fact, 30 apply for a duplicate or substitute certificate of registration or registration plate and 31 shall return to the department all parts of the original certificate of registration or

01 registration plates that the applicant possesses. 02 * Sec. 3. AS 28.10.161(a) is amended to read: 03  (a) Except for a vehicle registered under AS 28.10.152, the department, upon 04 registering a vehicle, shall issue the owner one fully reflectorized registration plate for 05 a trailer or a motorcycle and two fully reflectorized registration plates for every other 06 vehicle. When vehicle ownership is transferred or assigned, the registration plate 07 or plates shall remain with the owner or organization to whom they are issued. 08 The registration plate or plates may not be used on or transferred to a vehicle 09 other than the vehicle for which the plate or plates are issued without approval 10 of the department and payment of any required fees and taxes imposed under this 11 chapter. If the registration plate or plates issued under this section are 12 transferred to a vehicle for which the registration fee is more than the fee for the 13 vehicle from which the plates are transferred, the owner shall pay the difference 14 between the two fees. The registration plate or plates issued under this subsection 15 that a person is no longer entitled to use or the transfer of the registration plate 16 or plates to another vehicle that the department does not approve shall be 17 returned immediately to the department by the person or organization to whom 18 the plate or plates were originally issued [EXCEPT AS SPECIFICALLY 19 PROVIDED IN AS 28.10.181, THE PLATE OR PLATES MUST REMAIN WITH 20 THE VEHICLE AS LONG AS THE VEHICLE IS SUBJECT TO REGISTRATION 21 UNDER THIS CHAPTER]. 22 * Sec. 4. AS 28.10.181(a) is amended to read: 23  (a) The department shall register unique and special vehicles and vehicles used 24 for special purposes and issue registration plates as provided in this section. 25 [NOTWITHSTANDING OTHER PROVISIONS OF THIS CHAPTER, 26 REGISTRATION PLATES ISSUED UNDER THIS SECTION REMAIN WITH THE 27 PERSON OR ORGANIZATION TO WHOM THEY ARE ISSUED WHEN VEHICLE 28 OWNERSHIP IS TRANSFERRED OR TITLE OR INTEREST IN THE VEHICLE IS 29 ASSIGNED, EXCEPT FOR PLATES ISSUED UNDER (b), (h) AND (i) OF THIS 30 SECTION. REGISTRATION PLATES ISSUED UNDER THIS SECTION MAY NOT 31 BE USED ON, OR TRANSFERRED TO, A VEHICLE OTHER THAN THE

01 VEHICLE FOR WHICH THE PLATES ARE ISSUED WITHOUT THE APPROVAL 02 OF THE DEPARTMENT AND PAYMENT OF ANY REQUIRED FEES AND 03 TAXES PRESCRIBED IN AS 28.10.421(d), 28.10.431 AND 28.10.441; HOWEVER, 04 IF THE PLATES ISSUED UNDER (c), (f) AND (j) OF THIS SECTION ARE 05 TRANSFERRED TO A VEHICLE FOR WHICH THE REGISTRATION FEE IS 06 MORE THAN THE FEE FOR THE VEHICLE FROM WHICH THE PLATES ARE 07 TRANSFERRED, THE OWNER SHALL PAY THE DIFFERENCE BETWEEN THE 08 TWO FEES. REGISTRATION PLATES ISSUED UNDER THIS SECTION TO 09 WHICH A PERSON IS NO LONGER ENTITLED OR THE TRANSFER OF THE 10 PLATES TO ANOTHER VEHICLE WHICH THE DEPARTMENT DOES NOT 11 APPROVE SHALL BE RETURNED IMMEDIATELY TO THE DEPARTMENT BY 12 THE PERSON OR ORGANIZATION TO WHOM THE PLATES WERE 13 ORIGINALLY ISSUED.] 14 * Sec. 5. AS 28.10.181(b) is amended to read: 15  (b) Historic vehicles. The owner of an historic vehicle may make application 16 for special registration under this subsection. The department, when satisfied that the 17 vehicle meets the requirements for historic vehicle registration under regulations 18 adopted by the commissioner, shall register the vehicle and issue two permanent 19 registration plates of distinctive design and color bearing no date. Notwithstanding 20 AS 28.10.161(a), historic [THESE] plates remain with the vehicle as long as it is 21 registered under this subsection. Vehicles qualifying for registration under this 22 subsection shall be issued registration plates numbered in a separate numerical series 23 beginning with "Historic Vehicle No. 1." 24 * Sec. 6. AS 28.10.181(e) is amended to read: 25  (e) Vehicles owned by the state, municipalities, and charitable organizations 26 of the state. Every certificate of registration and registration plate issued to the state, 27 a municipality, or charitable organization of the state is in effect until the vehicle for 28 which the registration certificate and plate were issued or approved is no longer 29 owned and operated by the state, the municipality, or the charitable organization of the 30 state or until the department, in its discretion, declares its expiration. The state, 31 municipality, or charitable organization of the state shall maintain a current listing of

01 all vehicles registered to it in the order of the registration number assigned to each 02 vehicle [,] and shall provide a copy of the listing to the department upon request. The 03 listing must include a description of each vehicle and other identifying information 04 required by the department. Registration plates issued under this subsection must be 05 of a distinctive design and numbering system. For the purposes of this subsection, 06 "charitable organization" means a nonprofit association, corporation, society, or other 07 entity organized, incorporated, or headquartered in the state for educational, cultural, 08 scientific, or other charitable purposes, as prescribed in regulations of the department. 09 * Sec. 7. AS 28.10.271(a) is amended to read: 10  (a) When the owner of a registered vehicle transfers or assigns the owner's title 11 or interest in the vehicle, the registration of the vehicle expires; however, the 12 registration plates remain with the owner or organization [ON THE VEHICLE 13 EXCEPT] as [OTHERWISE] provided in AS 28.10.161(a) [AS 28.10.181]. 14 * Sec. 8. AS 28.10.331 is amended to read: 15  Sec. 28.10.331. Department to issue new certificates of title and 16 registration. The department, upon receipt of the certificate of title properly endorsed, 17 the certificate of registration, [THE REGISTRATION PLATES, IF ANY,] the 18 application for new title and registration, and all required fees and taxes, shall issue 19 a certificate of title and a certificate of registration to the transferee or the lienholder 20 lawfully entitled to the certificates. 21 * Sec. 9. AS 28.10.351 is amended to read: 22  Sec. 28.10.351. Dismantling or wrecking vehicle. A person who dismantles, 23 scraps, or destroys a registered vehicle shall immediately forward to the department 24 the certificates of title and registration [AND THE REGISTRATION PLATES] for the 25 vehicle. 26 * Sec. 10. APPLICABILITY. This Act applies to registration of a motor vehicle that 27 occurs on or after the effective date of this Act.
