00CS FOR SENATE BILL NO. 250(FIN) am 01 "An Act relating to management of game, to the fish and game fund and 02 federal aid for restoration of wildlife and fish, and to the duties of the 03 commissioner of fish and game." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. LEGISLATIVE FINDINGS. The legislature finds that providing for high 06 levels of harvest for human consumptive use, consistent with the sustained yield principle, is 07 the highest and best use of big game prey populations in most areas of the state and that big 08 game prey populations should be biologically managed for abundance. 09 * Sec. 2. AS 16.05.110 is amended by adding a new subsection to read: 10  (b) Except for money received as fisheries fines or forfeitures in settlement of 11 a claim or loss caused by damage to the fish resources of the state that is appropriated 12 to or through the division of commercial fisheries management and development, 13 appropriations of money from the fish and game fund and of money received by the 14 state under the federal aid acts described under AS 16.05.140 shall be made to or

01 through the division of game or the division of sport fish. The division of game or the 02 division of sport fish may use money appropriated under this subsection to acquire 03 administrative and other services from other agencies if the division acquires the 04 services through reimbursable services agreements. The division of game and the 05 division of sport fish shall include as part of their budgets prepared under 06 AS 37.07.050 07  (1) a listing of the reimbursable services agreements that are to be 08 funded with money appropriated under this subsection; 09  (2) a description of the services to be provided under those agreements; 10 and 11  (3) a listing of the entities that are parties to those agreements. 12 * Sec. 3. AS 16.05.255(g)(2) is amended to read: 13  (2) "intensive management" means management of an identified big 14 game prey population for sustained yield through active management measures to 15 enhance, extend, and develop the population to maintain high levels or provide for 16 higher levels of human harvest, including control of predation and prescribed or 17 planned use of fire and other habitat improvement techniques. 18 * Sec. 4. AS 16.05.255(g) is amended by adding new paragraphs to read: 19  (3) "harvestable surplus" means the number of animals that is estimated 20 to equal the number of offspring born in a game population during a year less 21 population enhancement, when necessary, and the number of animals in the population 22 that die from all causes, other than predation or human harvest, during that year; 23  (4) "high level of human harvest" means the opportunity with a high 24 probability of success for humans to harvest at least one-quarter of the harvestable 25 surplus of a game population; 26  (5) "sustained yield" means the achievement and maintenance in 27 perpetuity of a high level of human harvest of game, other than mammalian predators, 28 on an annual or periodic basis. 29 * Sec. 5. AS 16.05.255 is amended by adding a new subsection to read: 30  (h) The Board of Game shall establish population and harvest goals and 31 seasons to manage identified big game prey populations to achieve a high level of

01 human harvest. 02 * Sec. 6. AS 16.05.270 is amended to read: 03  Sec. 16.05.270. Delegation of authority to commissioner. (a) For the 04 purpose of administering AS 16.05.251 and 16.05.255, each board may delegate 05 authority to the commissioner to act on [IN] its behalf. 06  (b) If a board delegates authority to the commissioner to act on its behalf, 07 the commissioner shall cooperate with and assist the board by implementing 08 regulations, management plans, and other management programs as requested by 09 the board. 10  (c) If there is a conflict between the board and the commissioner on proposed 11 regulations, public hearings shall be held concerning the issues in question. If, after 12 the public hearings, the board and the commissioner continue to disagree, the issue 13 shall be certified in writing by the board and the commissioner to the governor , who 14 shall make a decision. The decision of the governor is final.
