00CS FOR SENATE BILL NO. 231(FIN) 01 "An Act making and amending capital, supplemental, and other appropriations; 02 making appropriations to capitalize funds; making appropriations under art. IX, 03 sec. 17(c), Constitution of the State of Alaska, from the constitutional budget 04 reserve fund; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. ALASKA CLEAN WATER FUND. The sum of $14,158,100 is appropriated 07 to the Alaska clean water fund (AS 46.03.032) for the Alaska clean water loan program from 08 the following sources: 09 General fund match $ 2,359,700 10 Federal receipts 11,798,400 11 * Sec. 2. ALASKA DRINKING WATER FUND. The sum of $8,808,400 is appropriated 12 to the Alaska drinking water fund (AS 46.03.036) for the Alaska drinking water loan program 13 from the following sources: 14 General fund match $1,468,100

01 Federal receipts 7,340,300 02 * Sec. 3. ARCTIC NATIONAL WILDLIFE REFUGE OIL AND GAS. (a) The sum of 03 $225,000 is appropriated from the general fund to the Department of Community and Regional 04 Affairs for payment as a grant under AS 37.05.316 to Arctic Power for education efforts to 05 open the coastal plain of the Arctic National Wildlife Refuge for oil and gas exploration and 06 development. 07 (b) The sum of $25,000 is appropriated from the general fund to the Department of 08 Administration for payment as a grant under AS 37.05.315 to the North Slope Borough for 09 education efforts to open the coastal plain of the Arctic National Wildlife Refuge for oil and 10 gas exploration and development. 11 * Sec. 4. CAPITAL PROJECT MATCHING GRANT PROGRAMS. (a) The sum of 12 $13,150,000 is appropriated from the general fund to the municipal capital project matching 13 grant fund (AS 37.06.010(b)) in the Department of Administration to provide grants to 14 municipalities under the municipal capital project matching grant program. 15 (b) The sum of $1,850,000 is appropriated from the general fund to the unincorporated 16 community capital project matching grant fund (AS 37.06.020(b)) in the Department of 17 Community and Regional Affairs to provide grants to unincorporated communities under the 18 unincorporated community capital project matching grant program. 19 (c) An amount equal to the interest earned on money in the individual grant accounts 20 in the municipal capital project matching grant fund (AS 37.06.010(b)) and the unincorporated 21 community capital project matching grant fund (AS 37.06.020(b)) is appropriated from the 22 general fund to the respective funds. The interest is calculated using the average percentage 23 interest rate received by other accounts in the state's general investment fund that received 24 interest during fiscal year 1998. The appropriations made by this subsection are allocated pro 25 rata to each individual grant account based on the balance of the account on the close of 26 business on June 30, 1998. 27 * Sec. 5. FINGERPRINT SYSTEM REPLACEMENT REAPPROPRIATION. (a) The 28 unexpended and unobligated balance of the appropriation made in sec. 82, ch. 100, SLA 1997, 29 page 55, lines 10 - 11 (Fingerprint system replacement - $1,400,000) is reappropriated to the 30 following departments in the amounts and for the purposes stated: 31 DEPARTMENT AND PURPOSE APPROPRIATION AMOUNT

RURAL ELECTRIFICATION REVOLVING LOAN FUND. Notwithstanding 12 AS 42.45.020(g), the balance of the rural electrification revolving loan fund (AS 42.45.020) 13 on June 30, 1998, is appropriated to the Department of Community and Regional Affairs for 14 the electrical emergencies program. 15 * Sec. 7. CONSTITUTIONAL BUDGET RESERVE FUND. (a) Amounts equal to the 16 deposits in the budget reserve fund (art. IX, sec. 17, Constitution of the State of Alaska) for 17 fiscal year 1998 that were made from subfunds and accounts in the general fund by operation 18 of art. IX, sec. 17(d), Constitution of the State of Alaska, to repay appropriations from the 19 budget reserve fund are appropriated from the budget reserve fund to the subfunds and 20 accounts from which they were transferred. 21 (b) If the unrestricted state revenue available for appropriation in fiscal year 1999 is 22 insufficient to cover the general fund appropriations made for fiscal year 1999, the amount 23 necessary to balance revenue and general fund appropriations is appropriated to the general 24 fund from the budget reserve fund (art. IX, sec. 17, Constitution of the State of Alaska). 25 (c) The appropriations in (a) and (b) of this section are made under art. IX, sec. 17(c), 26 Constitution of the State of Alaska. 27 * Sec. 8. Section 53, ch. 100, SLA 1997, is amended to read: 28  Sec. 53. AMERICAN RED CROSS GRANT LAPSE EXTENSION. That 29 portion of the appropriation made in sec. 30, ch. 117, SLA 1996, page 39, line 8 30 (Department of Military and Veterans' Affairs for disaster planning and control - 31 $3,161,000) that was awarded by the department as a grant to the American Red Cross

01 lapses into the funds from which appropriated on June 30, 1999 [1998]. 02 * Sec. 9. LAPSE EXTENSION OF FY 1998 AMERICAN RED CROSS GRANT. That 03 portion of the appropriation made in sec. 39, ch. 98, SLA 1997, page 41, line 17 (Department 04 of Military and Veterans' Affairs for disaster planning and control - $3,341,600) that was 05 awarded by the department as a grant to the American Red Cross lapses into the funds from 06 which appropriated on June 30, 1999. 07 * Sec. 10. (a) The sum of $9,500,000 is appropriated from the constitutional budget 08 reserve fund (art. IX, sec. 17, Constitution of the State of Alaska) to the Office of the 09 Governor, office of management and budget, for distribution to executive branch agencies, the 10 University of Alaska, and the Alaska Court System for assessment and remediation of the 11 "Year 2000" related computer problems. 12 (b) The appropriation in (a) of this section is made under art. IX, sec. 17(c), 13 Constitution of the State of Alaska. 14 * Sec. 11. The sum of $432,525 is appropriated from the public school trust fund 15 (AS 37.14.110(a)) to the Department of Natural Resources for the fiscal years ending June 30, 16 1998, and June 30, 1999, for an appraisal of public school lands to determine the fair market 17 value of the public school trust land where the land was redesignated as general grant land 18 in 1978. It is the intent of the legislature that the appraisal be completed by March 1, 1999. 19 * Sec. 12. The unexpended and unobligated balance of the international trade and business 20 endowment earnings reserve (AS 37.17.440) on June 30, 1998, is reappropriated to the 21 Department of Commerce and Economic Development, division of trade and development, to 22 support programs for the development of international trade and business in the state for the 23 fiscal year ending June 30, 1999. 24 * Sec. 13. The unexpended and unobligated balance, not to exceed $300,000, of the 25 appropriation made in sec. 82, ch. 100, SLA 1997, page 53, lines 11 - 13 (Domiciliary care 26 facilities, Fairbanks and Anchorage - $600,000) is reappropriated to the Department of Health 27 and Social Services for payment as a grant under AS 37.05.316 to the Fairbanks Native 28 Association for purchase of a facility for women and children. 29 * Sec. 14. EXXON VALDEZ OIL SPILL RESTORATION FUND. (a) The legislature 30 finds that 31 (1) as a result of the judgment entered by the United States District Court in

01 the criminal case United States of America v. Exxon Shipping Company and Exxon 02 Corporation, No. A90-015 CR, the state received $50,000,000 in restitution "to be used by the 03 State of Alaska . . . exclusively for restoration projects, within the State of Alaska, relating 04 to the `Exxon Valdez' oil spill"; 05 (2) the money received by the state in restitution is held in the "Exxon Valdez 06 oil spill restoration fund," established by the Department of Revenue, to implement the 07 judgment; and 08 (3) the appropriations in (b) and (c) of this section are made in order to 09 achieve the purposes in the court's restitution order. 10 (b) The sum of $400,000 is appropriated from the income accrued during the fiscal 11 year ending June 30, 1999, on the Exxon Valdez oil spill restoration fund described in (a) of 12 this section to the Department of Community and Regional Affairs for payment as a grant 13 under AS 37.05.316 to the North Pacific Rim Housing Authority for the purchase of a utility 14 master generation system. 15 (c) The sum of $30,000 is appropriated from the income accrued during the fiscal year 16 ending June 30, 1999, on the Exxon Valdez oil spill restoration fund described in (a) of this 17 section to the Department of Administration for payment as a grant under AS 37.05.315 to the 18 City of Cordova for fish net pens. 19 * Sec. 15. The general fund appropriation to the University of Alaska made in sec. 39, ch. 20 98, SLA 1997, page 51, line 22, includes the sum of $59,100 in satisfaction of the monetary 21 terms of the collective bargaining agreement entered into between the University of Alaska 22 and the United Academics for the fiscal year ending June 30, 1998. 23 * Sec. 16. (a) Section 39, ch. 98, SLA 1997, page 16, line 10, is amended to read: 24 APPROPRIATION GENERAL 25 ITEMS FUND 26 Longevity Bonus Grants 67,976,300 67,976,300 27 [70,153,600] [70,153,600] 28 (b) The sum of $383,600 is appropriated from the general fund to the Department of 29 Administration for the leasing program for the fiscal year ending June 30, 1998. 30 (c) The sum of $59,700 is appropriated from the general fund to the Department of 31 Administration for additional costs of the Elected Public Officers Retirement System for the

01 fiscal year ending June 30, 1998. 02 (d) Section 41, ch. 98, SLA 1997, page 57, line 26, is amended to read: 03 General Fund Receipts 156,823,000 [156,573,000] 04 (e) Section 41, ch. 98, SLA 1997, page 57, line 27, is amended to read: 05 General Fund/Program Receipts 15,598,900 [15,848,900] 06 (f) The sum of $98,200 is appropriated from federal receipts to the Department of 07 Administration, senior services division, for senior employment services for the fiscal years 08 ending June 30, 1998, and June 30, 1999. 09 (g) The sum of $28,700 is appropriated from general fund program receipts to the 10 Department of Commerce and Economic Development, division of insurance, for hearing- 11 examiner-related costs for the fiscal year ending June 30, 1998. 12 (h) The sum of $21,600 is appropriated from general fund program receipts to the 13 Department of Commerce and Economic Development, division of banking, securities and 14 corporations, for hearing-examiner-related costs for the fiscal year ending June 30, 1998. 15 (i) The sum of $56,800 is appropriated from the general fund to the Department of 16 Fish and Game for land lease costs at the Sikusuilaq hatchery for the fiscal year ending 17 June 30, 1998. 18 (j) The sum of $1,467,000 is appropriated to the Department of Military and Veterans' 19 Affairs for the Alaska National Guard youth corps challenge program or similar at-risk youth 20 intervention programs for the fiscal years ending June 30, 1998, and June 30, 1999, from the 21 following sources: 22 General fund $681,000 23 Federal receipts 786,000 24 * Sec. 17. DEPARTMENT OF CORRECTIONS. (a) The sum of $660,000 is 25 appropriated from the general fund to the Department of Corrections, division of institutions, 26 for increased operating costs for the fiscal year ending June 30, 1998, from the following 27 sources: 28 General fund $ 600,000 29 General fund/program receipts 60,000 30 (b) The sum of $230,000 is appropriated from the general fund to the Department of 31 Corrections, division of administration and support, for increased costs of prisoner

01 transportation for the fiscal year ending June 30, 1998. 02 * Sec. 18. DEPARTMENT OF EDUCATION. The sum of $75,000 is appropriated from 03 federal receipts to the Department of Education, Alaska Vocational Technical Center, for 04 grants to students for the fiscal year ending June 30, 1998. 05 * Sec. 19. DEPARTMENT OF FISH AND GAME. (a) The sum of $80,000 is 06 appropriated from Exxon Valdez oil spill restoration fund to the Department of Fish and Game 07 for continuation of a study of harbor seals in Prince William Sound for the fiscal year ending 08 June 30, 1998. 09 (b) The sum of $25,000 is appropriated from federal receipts to the Department of 10 Fish and Game for participation in bilateral discussions between the United States and Russia 11 on Bering Sea issues for the fiscal year ending June 30, 1998. 12 (c) The sum of $364,900 is appropriated from statutory designated program receipts 13 (AS 37.05.146(b)(3)) to the Department of Fish and Game, division of commercial fisheries 14 management and development, for special projects for the fiscal year ending June 30, 1998. 15 * Sec. 20. DEPARTMENT OF HEALTH AND SOCIAL SERVICES. (a) The sum of 16 $180,000 is appropriated from statutory designated program receipts (AS 37.05.146(b)(3)) to 17 the Department of Health and Social Services, health planning and facilities management, for 18 costs associated with the planning and design of the public health laboratory for the fiscal year 19 ending June 30, 1998. 20 (b) The sum of $1,306,600 is appropriated from federal receipts to the Department of 21 Health and Social Services for increased Medicaid school-based administrative claims 22 reimbursements for distribution to school districts for the fiscal year ending June 30, 1998. 23 (c) The sum of $12,018,400 is appropriated from federal receipts to the Department 24 of Health and Social Services, medical assistance, for entitlement growth and increased Indian 25 Health Service reimbursements for the fiscal year ending June 30, 1998. 26 (d) The sum of $866,667 is appropriated from federal receipts from Medicaid school- 27 based administrative reimbursements to the Department of Health and Social Services for costs 28 related to reducing the adoption caseload backlog for the fiscal years ending June 30, 1998, 29 and June 30, 1999. 30 (e) The sum of $1,241,500 is appropriated from federal receipts to the Department of 31 Health and Social Services, division of public health, for the women, infants, and children

01 nutrition program for the fiscal year ending June 30, 1998. 02 * Sec. 21. DEPARTMENT OF LAW. The sum of $1,186,460 is appropriated to the 03 Department of Law to pay judgments and claims against the state for the fiscal year ending 04 June 30, 1998, from the following sources: 05 General fund $865,700 06 Alaska Housing Finance Corporation corporate receipts 320,760 07 * Sec. 22. DEPARTMENT OF MILITARY AND VETERANS' AFFAIRS. (a) The sum 08 of $40,000 is appropriated from federal receipts to the Department of Military and Veterans' 09 Affairs, division of emergency services, for training required by the Federal Emergency 10 Management Agency at the Emergency Management Institute for the fiscal year ending 11 June 30, 1998. 12 (b) The sum of $11,000 is appropriated from statutory designated program receipts 13 (AS 37.05.146(b)(3)) to the Department of Military and Veterans' Affairs, state active duty, 14 for medivac and special missions costs for the fiscal year ending June 30, 1998. 15 * Sec. 23. (a) Section 29(a), ch. 98, SLA 1997 is amended to read: 16  (a) The [SUBJECT TO (b) OF THIS SECTION, THE] sum of $7,770,100 17 [$30,000,000] is appropriated from the general fund to the Department of Health and 18 Social Services for medical assistance and allocated equally for Medicaid non-facility 19 and Medicaid facilities components, and the appropriation from federal receipts made 20 by sec. 39 of this Act to the Department of Health and Social Services for medical 21 assistance and allocated for the Medicaid non-facility and Medicaid facilities 22 components is reduced by a total of $7,770,100 [$30,000,000]. 23 (b) The sum of $404,200 is appropriated from federal receipts to the Department of 24 Health and Social Services for additional operating costs relating to the foster care augmented 25 rate for special needs foster children for the fiscal year ending June 30, 1998. 26 * Sec. 24. DEPARTMENT OF NATURAL RESOURCES. (a) The sum of $118,500 is 27 appropriated from federal receipts to the Department of Natural Resources for geologic 28 materials center deferred maintenance, sample storage expansion, mining land records, mineral 29 deposit database, and guide to Alaska mineral data for the fiscal year ending June 30, 1998. 30 (b) The sum of $65,000 is appropriated from the agricultural revolving loan fund 31 (AS 03.10.040(a)) to the Department of Natural Resources for protection of collateral for loans

01 (b) The sum of $816,500 is appropriated from the Alaska debt retirement fund 02 (AS 37.15.011) to the general fund. 03 (c) The sum of $540,700 is appropriated from the general fund to the Department of 04 Corrections, division of institutions, for increased prisoner health care costs for the fiscal year 05 ending June 30, 1998. 06 (d) The sum of $1,695,700 is appropriated from the general fund to the Department 07 of Law for settlement of claims from the 1994 Koyukuk fall flood for the fiscal year ending 08 June 30, 1998. 09 (e) The sum of $13,000,000 is appropriated from the general fund to the Department 10 of Natural Resources for fire suppression activities for the fiscal year ending June 30, 1998. 11 * Sec. 31. The sum of $15,329,500 is appropriated from the school fund (AS 43.50.140) 12 to the Department of Education for state aid for costs of school construction under 13 AS 14.11.100. 14 * Sec. 32. The sum of $300,000 is appropriated from the general fund to the Department 15 of Law for additional costs in the criminal division associated with court challenges to the 16 statutes dealing with medical procedures and parental consent for abortions for the fiscal years 17 ending June 30, 1998, and June 30, 1999. 18 * Sec. 33. The sum of $290,000 is appropriated from the general fund to the Department 19 of Health and Social Services, youth facilities services, for additional operating costs relating 20 to overcrowding in youth facilities for the fiscal year ending June 30, 1998. 21 * Sec. 34. DEPARTMENT OF LABOR. The sum of $88,000 is appropriated from the 22 general fund to the Department of Labor for software required for the 2000 census for the 23 fiscal years ending June 30, 1998, and June 30, 1999. 24 * Sec. 35. The unexpended and unobligated balance, not to exceed $1,000,000 of the 25 appropriation made in sec. 39, ch. 98, SLA 1997, page 34, line 27, through page 35, line 7 26 (DHSS, Family and Youth Services - $25,693,300), is reappropriated to the Department of 27 Health and Social Services for front-line social workers for the fiscal year ending June 30, 28 1999. 29 * Sec. 36. CAPITAL MATCHING GRANTS. (a) Subject to the conditions set out in (c) 30 of this section, the sum of $655,524 is appropriated from the appropriate individual grant 31 accounts in the unincorporated community capital project matching grant fund (AS 37.06.020)

REPEALER. Section 29(b), ch. 98, SLA 1997, is repealed. 26 * Sec. 39. LAPSE PROVISIONS. (a) The appropriations made by secs. 1, 2, and 4 of 27 this Act are for capitalization of funds and do not lapse. 28 (b) The appropriations made by secs. 3(a), 5, 6, 10, 13, 14(b), and 37(a)(2) - (6) of 29 this Act are for capital projects and lapse under AS 37.25.020. 30 (c) The appropriation made by sec. 31 of this Act lapses June 30, 1999. 31 * Sec. 40. RETROACTIVITY. Sections 23(a) and 38 of this Act are retroactive to
