SB 214: "An Act relating to the possession of a concealed deadly weapon by peace officers and chief administrative officers of local police departments; to the definition of police officer as it is defined for police standards; and providing for an effective date."

00SENATE BILL NO. 214 01 "An Act relating to the possession of a concealed deadly weapon by peace officers 02 and chief administrative officers of local police departments; to the definition of 03 police officer as it is defined for police standards; and providing for an effective 04 date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 11.61.220(h) is repealed and reenacted to read: 07  (h) The provisions of (a)(1) of this section do not apply to a 08  (1) peace officer of this state or a municipality of this state acting 09 within the scope and authority of the officer's employment; 10  (2) peace officer employed by another state or a political subdivision of 11 another state who, at the time of the possession, is 12  (A) certified as a peace officer by the other state; and 13  (B) acting within the scope and authority of the officer's 14 employment; or

01  (3) police officer or chief administrative officer of this state or a 02 municipality of this state; in this paragraph, "police officer" and "chief administrative 03 officer" have the meanings given in AS 18.65.290. 04 * Sec. 2. AS 18.65.290(5) is amended to read: 05  (5) "police officer" means 06  (A) a full-time employee of the state or a municipal [LOCAL] 07 police department with the authority to arrest and issue citations; detain a 08 person taken into custody until that person can be arraigned before a judge or 09 magistrate; conduct investigations of violations of and enforce criminal laws, 10 regulations, and traffic laws; search with or without a warrant persons, 11 dwellings, and other forms of property for evidence of a crime; [CARRY A 12 CONCEALED WEAPON;] and take other action consistent with exercise of 13 these enumerated powers when necessary to maintain the public peace; 14  (B) an officer or employee of the Department of Transportation 15 and Public Facilities who is stationed at an international airport and has been 16 designated to have the general police powers authorized under AS 02.15.230(a); 17  (C) a University of Alaska public safety officer with general 18 police powers authorized under AS 14.40.043; 19 * Sec. 3. Sections 1 and 2 of this Act take effect only if HCS CSSB 141(FIN) am H, 20 Twentieth Alaska State Legislature, becomes law notwithstanding the governor's veto. 21 * Sec. 4. Section 3 of this Act takes effect immediately under AS 01.10.070(c).
