00CS FOR SENATE BILL NO. 192(FIN) 01 "An Act relating to maintenance of state marine vessels; and providing for an 02 effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 36.90 is amended by adding a new section to read: 05  Sec. 36.90.049. Maintenance of state marine vessels. (a) A marine vessel 06 owned by the state shall be maintained and repaired at a shipyard facility located in 07 the state unless the commissioner of the department that operates the marine vessel 08 determines in writing that there is no shipyard facility located in the state that is 09 equipped or qualified to perform the particular maintenance or repair required, or, after 10 taking into consideration the Alaska bidder preference set out in AS 36.30.170 and the 11 interport differential, that the proposed cost of the maintenance or repair work is 12 unreasonable. A detailed list of the costs and factors considered in calculating the 13 interport differential must be provided to each person who expresses an interest in 14 submitting a bid to perform maintenance or repair work on a marine vessel owned by

01 the state. 02  (b) The competitive bid provisions of AS 36.30 do not apply to a contract for 03 the maintenance or repair of a marine vessel owned by the state if the contract is 04 awarded to a shipyard facility in the state. 05  (c) The commissioner of the department that operates a marine vessel shall 06 adopt regulations establishing the criteria that the department shall use to determine 07 whether the cost of maintenance or repair work at a shipyard facility located in the 08 state is reasonable under (a) of this section. The commissioner of the department that 09 operates a marine vessel shall designate by regulation the designated base port for each 10 vessel operated by the department; however, the designated base port for marine 11 vessels of the Alaska marine highway system is Ketchikan for those vessels primarily 12 serving that portion of the state east of the longitude of Icy Cape and is Seward for 13 those vessels primarily serving the remainder of the state. A vessel's designated base 14 port is the vessel's delivery and redelivery port. 15  (d) The commissioner of the department that operates a marine vessel shall 16 adopt regulations establishing the criteria that the commissioner shall use in calculating 17 the interport differential under this section. The criteria for calculating the interport 18 differential must include costs incurred from the time that the vessel leaves the vessel's 19 designated base port to enter the shipyard facility until the time that the vessel returns 20 to the designated base port from the shipyard facility. 21  (e) In this section, 22  (1) "commissioner of the department that operates the marine vessel" 23 includes the president of the University of Alaska with regard to a vessel operated by 24 the university; 25  (2) "interport differential" includes all costs related to the performance 26 of the maintenance or repair work of a marine vessel at a shipyard, including travel 27 costs incurred moving the vessel from its designated base port to the shipyard, 28 additional fuel consumption, cost of consumables including lubricants and other engine 29 and deck stores, maintenance costs incurred during running time, cost of crew transfers 30 including airfare between the designated base port and the shipyard, wages in travel 31 status, crew room and board, and other interport costs identified by the commissioner

01 of the department that operates the marine vessel. 02 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
