DEPARTMENT OF NATURAL RESOURCES. (a) Subject to the condition 29 set out in this subsection, the sum of $279,000 is appropriated from the Exxon Valdez oil spill 30 settlement trust recognized in AS 37.14.400 to the Department of Natural Resources for the 31 purchase of the Overlook Park parcel. The appropriation made by this section is conditioned
01 on the Department of Natural Resources and the Kachemak Bay Conservation Society entering 02 into an agreement under which the Society agrees to assume responsibility for monitoring 03 Overlook Park and keeping it clean. 04 (b) It is the intent of the legislature that there will be no state funds required in the 05 future for operating costs for Overlook Park or for capital improvements to the park. 06 * Sec. 43. CAPITAL PROJECT MATCHING GRANT PROGRAMS. (a) The sum of 07 $17,533,000 is appropriated to the municipal capital project matching grant fund 08 (AS 37.06.010(b)) in the Department of Administration to provide grants to municipalities 09 under the municipal capital project matching grant program from the following sources in the 10 amounts listed: 11 SOURCE AMOUNT 12 General fund $13,150,000 13 Alaska Housing Finance Corporation revolving fund 4,383,000 14 (AS 18.56.082) from corporate receipts 15 (b) The sum of $2,467,000 is appropriated to the unincorporated community capital 16 project matching grant fund (AS 37.06.020(b)) in the Department of Community and Regional 17 Affairs to provide grants to unincorporated communities under the unincorporated community 18 capital project matching grant program from the following sources in the amounts listed: 19 SOURCE AMOUNT 20 General fund $1,850,000 21 Alaska Housing Finance Corporation revolving fund 617,000 22 (AS 18.56.082) from corporate receipts 23 (c) Amounts equal to the interest earned on money in the individual grant accounts 24 in the municipal capital project matching grant fund (AS 37.06.010(b)) and the 25 unincorporated community capital project matching grant fund (AS 37.06.020(b)) are 26 appropriated from the general fund to the respective funds. The amount of interest is 27 calculated using the average percentage interest rate received by other accounts in the state's 28 general investment fund that received interest during fiscal year 1997. The appropriations 29 made by this subsection are allocated pro rata to each individual grant account based on the 30 balance of the account on the close of business on June 30, 1997. 31 * Sec. 44. FEDERAL AND OTHER PROGRAM RECEIPTS. (a) Federal receipts and
01 receipts of or from the trust established by AS 37.14.400 - 37.14.450 (Exxon Valdez oil spill 02 trust) that exceed the amounts appropriated by this Act are appropriated conditioned on 03 compliance with the program review provisions of AS 37.07.080(h). 04 (b) Contingent on the passage by the First Regular Session of the Twentieth Alaska 05 State Legislature and enactment into law of a bill defining "designated program receipts," 06 designated program receipts as defined by law that exceed the amounts appropriated by this 07 Act are appropriated conditioned on compliance with the program review provisions of 08 AS 37.07.080(h). 09 (c) It is the intent of the legislature that requests for approval of revised programs 10 may be submitted to the Legislative Budget and Audit Committee through the program 11 review process established under AS 37.07.080(h), and that the revised programs be limited 12 to only those items of an emergency nature, such as the loss of funds if action is not taken 13 until the next session of the legislature. Unless the legislature has expressly provided through 14 legislative intent that a revised program be submitted to the Legislative Budget and Audit 15 Committee for a particular agency or program, the Legislative Budget and Audit Committee 16 program review process should not be used to restore funding for budget reductions made by 17 the Twentieth Alaska State Legislature or for program enhancements that must be considered 18 by the full legislature at the next session of the legislature. Requests for capital budget items 19 should be limited to requests for review of emergency items, such as flood damage repair 20 from new federal funds. The Legislative Budget and Audit Committee program review 21 process should not be used to establish new capital projects or to change funding sources for 22 existing capital projects; such requests should be held for consideration by the full legislature 23 during the regular capital appropriation process. 24 (d) If federal or other program receipts as defined in AS 37.05.146 exceed the 25 estimates appropriated by this Act, the appropriations from state funds for the affected 26 program may be reduced by the excess if the reductions are consistent with applicable federal 27 statutes. 28 * Sec. 45. RURAL ELECTRIFICATION REVOLVING LOAN FUND. The balance of 29 the rural electrification revolving loan fund (AS 42.45.020) on June 30, 1997, is appropriated 30 from the loan fund to the Department of Community and Regional Affairs for the electrical 31 emergencies program.
01 * Sec. 46. REPEAL OF PRIOR YEAR CAPITAL APPROPRIATIONS. (a) The 02 unexpended and unobligated balance of an appropriation for a capital project is repealed on 03 (1) June 30, 1998, if the appropriation was effective before July 1, 1991, and 04 the appropriation has not been amended, or, if amended, the most recent amendment to the 05 appropriation was effective before July 1, 1993; 06 (2) June 30, 1999, if the appropriation was effective after June 30, 1993, but 07 before July 1, 1994, and the appropriation has not been amended, or, if amended, the most 08 recent amendment to the appropriation was effective before July 1, 1994; 09 (3) June 30, 2000, if the appropriation was effective after June 30, 1994, but 10 before July 1, 1995, and the appropriation has not been amended, or, if amended, the most 11 recent amendment to the appropriation was effective before July 1, 1995; 12 (4) June 30, 2001, if the appropriation was effective after June 30, 1995, but 13 before July 1, 1996, and the appropriation has not been amended, or, if amended, the most 14 recent amendment to the appropriation was effective before July 1, 1996; 15 (5) June 30, 2002, if the appropriation was effective after June 30, 1996, but 16 before July 1, 1997, and the appropriation has not been amended, or, if amended, the most 17 recent amendment to the appropriation was effective before July 1, 1997. 18 (b) This section does not apply to an appropriation to capitalize a fund. 19 (c) The legislature intends to consider any request to amend an appropriation for a 20 capital project subject to (a) of this section if substantial ongoing work on the project has 21 been started, the project is not expected to be completed by the date of the repeal of the 22 appropriation, the requested amendment to extend the appropriation is included in the 23 governor's annual capital budget, and the governor includes with the requested extension 24 (1) a description of changes to the scope of the project since the initial 25 proposal, if any; 26 (2) the current status of the project; 27 (3) the anticipated project completion date; 28 (4) the unexpended and unobligated balance of the appropriation; and 29 (5) the current estimate of the amount required to complete the project. 30 * Sec. 47. FEDERAL TRANSPORTATION MATCHING FUNDS. (a) The unexpended 31 and unobligated balance, not to exceed $1,500,000, of the appropriations from the general

ALASKA SEAFOOD MARKETING INSTITUTE. (a) Contingent on the
01 Alaska Seafood Marketing Institute having no employees who are located outside Alaska 02 whose positions are classified at more than Range 21 on the state salary schedule under 03 AS 39.27.011, and subject to the conditions set out in (b) - (d) of this section, the 04 appropriation made by sec. 31, ch. 117, SLA 1996, page 58, lines 8 - 11, lapses into the 05 general fund June 30, 2000. 06 (b) The Alaska Seafood Marketing Institute may not spend money from this 07 appropriation in the fiscal year ending June 30, 1998. 08 (c) Of the amount appropriated in (a) of this section, the Alaska Seafood Marketing 09 Institute may spend no more than $500,000 in the fiscal year ending June 30, 1999. 10 (d) Of the amount appropriated in (a) of this section, the Alaska Seafood Marketing 11 Institute may spend no more than $500,000 in the fiscal year ending June 30, 2000. 12 * Sec. 49. EXXON VALDEZ OIL SPILL RESTORATION FUND. (a) The legislature 13 finds that 14 (1) as a result of the judgment entered by the United States District Court in 15 the criminal case United States of America v. Exxon Shipping Company and Exxon 16 Corporation, No. A90-015 CR, the state received $50,000,000 in restitution "to be used by the 17 State of Alaska . . . exclusively for restoration projects, within the State of Alaska, relating 18 to the `Exxon Valdez' oil spill"; 19 (2) the money received by the state in restitution is held in the "Exxon Valdez 20 oil spill restoration fund," established by the Department of Revenue, to implement the 21 judgment; and 22 (3) the appropriations in (b) and (c) of this section are made in order to 23 achieve the purposes in the court's restitution order. 24 (b) The sum of $250,000 is appropriated from the income accrued on or before 25 June 30, 1998, on the Exxon Valdez oil spill restoration fund described in (a) of this section 26 to the Department of Fish and Game for the acquisition of equipment for the Mariculture 27 Technical Center and Shellfish Hatchery. 28 (c) The sum of $1,400,000 is appropriated from the income accrued on or before 29 June 30, 1998, on the Exxon Valdez oil spill restoration fund described in (a) of this section 30 to the Department of Transportation and Public Facilities for the construction of a road from 31 Cordova to Shepard Point, the construction of oil spill response equipment storage facilities,
01 and the acquisition of oil spill response equipment for prepositioning at Shepard Point. 02 * Sec. 50. ALYESKA SETTLEMENT FUND. (a) Subject to the condition in this 03 subsection, the unappropriated and unobligated balance of the income earned on or before 04 June 30, 1998, on money in the Alyeska settlement fund is appropriated to the Department of 05 Transportation and Public Facilities for the construction of a road from Cordova to Shepard 06 Point, the construction of oil spill response equipment storage facilities, and the acquisition 07 of oil spill response equipment for prepositioning at Shepard Point. To the extent that there 08 are other appropriations made for a project under this appropriation, this appropriation is 09 conditioned on the department's exhausting the other appropriations made for a project under 10 this appropriation before expending money from this appropriation for that project. 11 (b) In this section, the "Alyeska settlement fund" means the trust fund established in 12 the state treasury for the purpose of receiving, holding, and disbursing the settlement proceeds 13 received by the state under the Agreement and Consent Decree In Re: The Exxon Valdez, 14 United States District Court, District of Alaska, Case No. A92-175 Civil, decree entered 15 November 25, 1992. 16 * Sec. 51. The sum of $108,474 is appropriated from the general fund to the Department 25 of Law to pay for judgments and claims against the state for the fiscal year ending 26 June 30, 1997. 27 * Sec. 53. ALASKA COAL WATER FUEL EXPORT AND DIESEL ENGINE PROJECT. 28 (a) The sum of $3,800,000 is appropriated from the income of the Alaska science and 29 technology endowment (AS 37.17.020(a)) to the low-rank coal water fuel project reserve in 30 the Alaska Science and Technology Foundation for payment as a grant under AS 37.17.090(k) 31 for demonstrating the use of Alaska low-rank coal water fuel in diesel engines and developing
01 Alaska low-rank coal water fuel as a product for commercial export. 02 (b) The sum of $22,500,000 is appropriated from university receipts to the University 03 of Alaska for the Alaska low-rank coal water fuel export and diesel engine project. 04 (c) The appropriation made by (a) of this section lapses into the Alaska science and 05 technology endowment income account December 31, 1997, unless the Board of Directors of 06 the Alaska Science and Technology Foundation certifies on or before that date that all of the 07 necessary participants in the Alaska low-rank coal water fuel export and diesel engine project 08 have agreed to participate in the project. 09 * Sec. 54. AMERICAN RED CROSS GRANT LAPSE EXTENSION. That portion of the 10 appropriation made in sec. 30, ch. 117, SLA 1996, page 39, line 8 (Department of Military 11 and Veterans' Affairs for disaster planning and control - $3,161,000) that was awarded by the 12 department as a grant to the American Red Cross lapses into the funds from which 13 appropriated on June 30, 1998. 14 * Sec. 55. LAPSE PROVISIONS. (a) The appropriations made by secs. 39, 40, and 43 15 of this Act are for capitalization of funds and do not lapse under AS 37.25.010. 16 (b) The appropriations made by secs. 11, 13, 17(a), 18(b), 22(c), 23(a), 29, 32(a)(1) - 17 (3), 32(c), 33(a), 34(a), 34(b), 35(c), 37, 42, 44, 45, 47(b), 49 - 51, 53, and 58 of this Act are 18 for capital projects and lapse under AS 37.25.020. 19 (c) The appropriations made by secs. 19 and 41(c) of this Act lapse June 30, 1998. 20 * Sec. 56. RETROACTIVITY. (a) If they take effect after June 30, 1997, secs. 45 and 21 46 of this Act are retroactive to June 30, 1997. 22 (b) Section 26(c) of this Act is retroactive to July 1, 1994. 23 * Sec. 57. EFFECTIVE DATES. (a) Sections 1 - 26, 27(a), 27(b), 28 - 38, 41(a), 41(b), 24 45 - 48, 52, and 54 - 56 of this Act take effect immediately under AS 01.10.070(c). 25 (b) Sections 39, 40, 41(c), 42 - 44, 49 - 51, 53, 58, and 59 of this Act take effect 26 July 1, 1997. 27 (c) Section 27(c) of this Act takes effect on the day after sec. 58 of this Act takes 28 effect. 29 (SECTION 58 OF THIS ACT BEGINS ON PAGE 29)
