00CS FOR SENATE BILL NO. 74(FIN) am H 01 "An Act making appropriations concerning the state's position on the sovereign 02 powers of Native tribal governments in the state; and providing for an effective 03 date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. (a) The sum of $500,000 is appropriated from the general fund to the 06 Department of Law for the purpose of advocating the state's legal position on the sovereign 07 powers of Native tribal governments in the state, including representation and advocacy before 08 federal and state courts and federal administrative agencies. 09 (b) Subject to the condition set out in (c) of this section, the sum of $500,000 is 10 appropriated from the general fund to the Legislative Council for the purpose of supporting 11 the state's interest, including litigation, on the issue of the sovereign powers of Native tribal 12 governments in the state in light of the decision of the federal Ninth Circuit Court of Appeals 13 in State of Alaska v. Native Village of Venetie Tribal Government (9th Cir. Case No. 96- 14 35042, decided November 20, 1996).
01 (c) The appropriation made in (b) of this section may not be encumbered or expended 02 until the encumbrance or expenditure has been approved by the Legislative Council in a 03 meeting. 04 * Sec. 2. The appropriations made by this Act lapse June 30, 1998. 05 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
