00HOUSE JOINT RESOLUTION NO. 102 01 Proposing amendments to the Constitution of the State of Alaska relating to 02 establishing a preference for subsistence uses of fish and wildlife; and providing 03 for an effective date. 04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. Article VIII, sec. 4, Constitution of the State of Alaska, is amended to read: 06  Section 4. Sustained Yield. (a) Fish, forests, wildlife, grasslands, and all 07 other replenishable resources belonging to the State shall be utilized, developed, and 08 maintained on the sustained yield principle, subject to preferences among beneficial 09 uses. 10 * Sec. 2. Article VIII, sec. 4, Constitution of the State of Alaska, is amended by adding 11 a new subsection to read: 12  (b) The legislature shall establish, consistent with the sustained yield principle, 13 a preference for subsistence uses of fish and wildlife that takes effect when a fish or 14 wildlife resource is not sufficient to accommodate all beneficial uses of the resource.

01 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 02 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 03 State of Alaska, and the election laws of the state. 04 * Sec. 4. If adopted by the voters at the next general election, the amendments proposed 05 by this resolution takes effect immediately upon certification of the election returns by the 06 lieutenant governor.
