HJR 26: Proposing amendments to the Constitution of the State of Alaska relating to the preferred use of fish, wildlife, and other replenishable resources and prohibiting the use of the initiative and referendum in regard to certain matters relating to fish, wildlife, and other replenishable resources.

00HOUSE JOINT RESOLUTION NO. 26 01 Proposing amendments to the Constitution of the State of Alaska relating to the 02 preferred use of fish, wildlife, and other replenishable resources and prohibiting 03 the use of the initiative and referendum in regard to certain matters relating to 04 fish, wildlife, and other replenishable resources. 05 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. Article VIII, Constitution of the State of Alaska, is amended by adding a new 07 section to read: 08  Section 19. Preferred Use of Fish, Wildlife, and Other Replenishable 09 Resources. The nonwasteful harvest of fish, wildlife, and other replenishable 10 resources belonging to the State is preferred over other uses of those resources. 11 * Sec. 2. Article XI, sec. 7, Constitution of the State of Alaska, is amended to read: 12  Section 7. Restrictions. The initiative shall not be used to dedicate revenues, 13 make or repeal appropriations, create courts, define the jurisdiction of courts or 14 prescribe their rules, provide for the utilization, development, or conservation of

01 fish, wildlife, and other replenishable resources, or enact local or special legislation. 02 The referendum shall not be applied to dedications of revenue, to appropriations, to 03 local or special legislation, to the utilization, development, or conservation of fish, 04 wildlife, and other replenishable resources, or to laws necessary for the immediate 05 preservation of the public peace, health, or safety. 06 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 07 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 08 State of Alaska, and the election laws of the state.
