00CS FOR HOUSE JOINT RESOLUTION NO. 18(STA) 01 Proposing amendments to the Constitution of the State of Alaska relating to 02 changing the rate of a tax or license that supports a dedication of its proceeds. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article IX, sec. 7, Constitution of the State of Alaska, is amended to read: 05  Section 7. Dedicated Funds. The proceeds of any state tax or license shall 06 not be dedicated to any special purpose, except as provided in section 15 of this article 07 or when required by the federal government for state participation in federal programs. 08 This provision shall not prohibit the continuance of any dedication for special purposes 09 existing on April 24, 1956, and shall not prohibit the legislature from changing the 10 rate of the tax or license the proceeds of which are dedicated for a special 11 purpose under the continuance [UPON THE DATE OF RATIFICATION OF THIS 12 SECTION BY THE PEOPLE OF ALASKA]. 13 * Sec. 2. Article XV, Constitution of the State of Alaska, is amended by adding a new 14 section to read:

01  Section 29. Effective Date and Retroactive Effect of Amendment to 02 Section 7 of Article IX. The 1998 amendment permitting changes in the rate of a tax 03 or license that is dedicated to a special purpose (art. IX, sec. 7) shall take effect the 04 day after certification of the election returns by the lieutenant governor and is 05 retroactive to October 1, 1997. 06 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 07 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 08 State of Alaska, and the election laws of the state.
