00HOUSE BILL NO. 397 01 "An Act making supplemental appropriations; making, amending, and repealing 02 capital or other appropriations; making appropriations to capitalize funds; and 03 providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. APPROPRIATIONS THAT ARE TIME-SENSITIVE. (a) The sum of 06 $1,786,400 is appropriated from corporate receipts of the Alaska Housing Finance Corporation 07 to the Department of Revenue, Alaska Housing Finance Corporation, for costs relating to 08 operation and maintenance of the Bank of America building for the fiscal year ending 09 June 30, 1998. 10 (b) The purpose of this subsection is to appropriate federal money that is anticipated 11 to be received under the disaster declaration portion of the Magnuson-Stevens Fishery 12 Conservation and Management Act (16 U.S.C. 1801 - 1883) applicable to the Bristol Bay 13 Region. The state would essentially be providing $1,875,000 of fisheries taxes received under 14 AS 43.75 as the required state general fund match. The sum of $8,875,000 is appropriated

01 to the Department of Community and Regional Affairs, division of municipal and regional 02 assistance, for the Bristol Bay economic disaster from the following sources: 03 General fund $ 1,875,000 04 Federal receipts 7,000,000 05 (c) The sum of $886,000 is appropriated to the Department of Corrections, division 06 of institutions, for additional costs of community residential centers for the fiscal year ending 07 June 30, 1998, from the following sources: 08 General fund $ 236,000 09 General fund/program receipts 650,000 10 (d) The sum of $100,000 is appropriated from general fund program receipts to the 11 Department of Health and Social Services for maternal child care health specialty clinics for 12 the fiscal year ending June 30, 1998. 13 (e) The sum of $20,000,000 is appropriated from federal receipts to the Department 14 of Military and Veterans' Affairs for transfer to the University of Alaska to upgrade and 15 modernize the Poker Flats Research Range. 16 (f) The sum of $8,500,000 is appropriated from federal receipts to the Department of 17 Transportation and Public Facilities for resurfacing, rehabilitation, and restoration of the 18 Glennallen to Tok Interstate Highway. 19 (g) The sum of $120,600 is appropriated from federal receipts to the Department of 20 Fish and Game, subsistence division, for additional project activities for the fiscal year ending 21 June 30, 1998. 22 (h) The sum of $3,000,000 is appropriated from the general fund to the Department 23 of Labor for programs to mitigate the impact of the Bristol Bay economic disaster for the 24 fiscal year ending June 30, 1998. 25 (i) The sum of $20,000,000 is appropriated from university receipts, transferred under 26 (e) of this section, to the University of Alaska to upgrade and modernize the Poker Flats 27 Research Range. 28 (j) The sum of $608,000 is appropriated from the general fund from reallocated 29 Medicaid state match to the Department of Military and Veterans' Affairs to cover a shortfall 30 in federal receipts for the Alaska National Guard youth corps challenge program for the fiscal 31 year ending June 30, 1998.

01 (k) The sum of $1,029,400 is appropriated from the general fund to the Department 02 of Administration for additional costs of the leasing program as a result of underfunding the 03 operating budget for the fiscal year ending June 30, 1998. 04 * Sec. 2. DEPARTMENT OF ADMINISTRATION. (a) The unexpended and unobligated 05 balance on May 31, 1998, not to exceed $1,000,000, of the appropriation made in sec. 39, 06 ch. 98, SLA 1997, page 16, line 10 (Longevity Bonus Grants - $70,153,600) is reappropriated 07 to the Department of Administration for the fiscal year ending June 30, 1998 for the following 08 purposes and in the amounts stated: 09 PURPOSE APPROPRIATION AMOUNT 10 (1) Office of public advocacy operating costs $ 265,400 11 (2) Public defender agency operating expenses 351,000 12 (3) Leasing program 383,600 13 (b) The sum of $59,700 is appropriated from the general fund to the Department of 14 Administration for additional costs of the Elected Public Officers Retirement System for the 15 fiscal year ending June 30, 1998. 16 (c) The following amendments to ch. 98, SLA 1997 are made to change the source 17 of a portion of the appropriation for operations of the pioneers homes in the Department of 18 Administration from general fund program receipts to general fund receipts for the fiscal year 19 ending June 30, 1998: 20 (1) sec. 41, ch. 98, SLA 1997, page 57, line 26, is amended to read: 21 General Fund Receipts 156,823,000 [156,573,000] 22 (2) sec. 41, ch. 98, SLA 1997, page 57, line 27, is amended to read: 23 General Fund/Program Receipts 15,598,900 [15,848,900] 24 * Sec. 3. DEPARTMENT OF COMMERCE AND ECONOMIC DEVELOPMENT. (a) 25 The sum of $28,700 is appropriated from general fund program receipts to the Department of 26 Commerce and Economic Development, division of insurance, for hearing examiner related 27 costs for the fiscal year ending June 30, 1998. 28 (b) The sum of $21,600 is appropriated from general fund program receipts to the 29 Department of Commerce and Economic Development, division of banking, securities and 30 corporations, for hearing examiner related costs for the fiscal year ending June 30, 1998. 31 * Sec. 4. DEPARTMENT OF COMMUNITY AND REGIONAL AFFAIRS. (a) The sum

01 of $1,700,000 is appropriated from corporate receipts of the Alaska Housing Financing 02 Corporation that were generated from the oil overcharge (stripper well) receipts to the power 03 cost equalization and rural electric capitalization fund (AS 42.45.100) to capitalize the fund. 04 (b) The sum of $1,700,000 is appropriated from the power cost equalization and rural 05 electric capitalization fund (AS 42.45.100) to the Department of Community and Regional 06 Affairs, power cost equalization program, for that program for the fiscal year ending 07 June 30, 1998. 08 * Sec. 5. DEPARTMENT OF CORRECTIONS. (a) The sum of $50,000 is appropriated 09 from the general fund to the Department of Corrections, parole board, for increased operating 10 costs due to more prisoners to review for the fiscal year ending June 30, 1998. 11 (b) The sum of $721,000 is appropriated from the general fund to the Department of 12 Corrections, division of institutions, for increased operating costs due to prison overcrowding 13 for the fiscal year ending June 30, 1998, from the following sources: 14 General fund $ 661,000 15 General fund/program receipts 60,000 16 (c) The sum of $2,500,000 is appropriated from the general fund to the Department 17 of Corrections, division of institutions, for increased prisoner health care costs for the fiscal 18 year ending June 30, 1998. 19 (d) The sum of $240,000 is appropriated from the general fund to the Department of 20 Corrections, division of administration and support, for increased costs of prisoner 21 transportation due to prison overcrowding for the fiscal year ending June 30, 1998. 22 * Sec. 6. DISASTER RELIEF FUND. The sum of $2,000,000 is appropriated from the 23 general fund to the disaster relief fund (AS 26.23.300) to capitalize the fund. 24 * Sec. 7. DEPARTMENT OF EDUCATION. The sum of $75,000 is appropriated from 25 federal receipts to the Department of Education, Alaska Vocational Technical Center, for 26 grants to students for the fiscal year ending June 30, 1998. 27 * Sec. 8. DEPARTMENT OF FISH AND GAME. (a) The sum of $56,800 is 28 appropriated from the general fund to the Department of Fish and Game for land lease costs 29 at the Sikusuilaq hatchery for the fiscal year ending June 30, 1998. 30 (b) The sum of $463,800 is appropriated from receipts of commercial fisheries test 31 fishing operations (AS 37.05.146(b)(4)(U)) to the Department of Fish and Game for costs

01 associated with the Sitka herring roe on kelp fishery for the fiscal year ending June 30, 1998. 02 (c) The following amendments to ch. 123, SLA 1996 are made to change the source 03 of a portion of the appropriation to the Department of Fish and Game for construction of an 04 indoor shooting range and hunter education facility at Fairbanks: 05 (1) sec. 100, ch. 123, SLA 1996, page 52, lines 18 - 22, are amended to read: 06 APPROPRIATION GENERALOTHER 07 ITEMS FUND FUNDS 08 Fairbanks Indoor Shooting Range 2,000,000 2,000,000 09  and Hunter Education Facility 10  Construction 11 This project is funded with 75% [50%] State Fish and Game Funds and 25% [50%] 12 Federal Fish and Game Funds. 13 (2) sec. 101, ch. 123, SLA 1996, page 87, line 18, is amended to read: 14 Federal Receipts 2,057,500 [2,557,500] 15 (3) sec. 101, ch. 123, SLA 1996, page 87, line 20, is amended to read: 16 Fish and Game Fund 3,142,500 [2,642,500] 17 (d) The sum of $56,000 is appropriated from the general fund to the Department of 18 Fish and Game, subsistence division, for additional operating costs for the fiscal year ending 19 June 30, 1998. 20 (e) The sum of $80,000 is appropriated from Exxon Valdez oil spill restoration fund 21 to the Department of Fish and Game for continuation of a study of harbor seals in Prince 22 William Sound for the fiscal year ending June 30, 1998. 23 (f) The sum of $25,000 is appropriated from federal receipts to the Department of Fish 24 and Game for participation in bilateral discussions between the United States and Russia on 25 Bering Sea issues for the fiscal year ending June 30, 1998. 26 * Sec. 9. DEPARTMENT OF HEALTH AND SOCIAL SERVICES. 01 Alaska Temporary 111,363,900 02 Assistance Program [112,863,900] 03 (b) The sum of $18,000 is appropriated from general fund program receipts to the 04 Department of Health and Social Services, bureau of vital statistics, for unanticipated leased 05 space costs for the fiscal year ending June 30, 1998. 06 (c) The sum of $180,000 is appropriated from statutory designated program receipts 07 to the Department of Health and Social Services, health planning and facilities management, 08 for costs associated with the planning and design of the public health laboratory for the fiscal 09 year ending June 30, 1998. 10 (d) The sum of $1,484,300 is appropriated from the general fund to the Department 11 of Health and Social Services for increased operating costs for the general relief medical 12 program for the fiscal year ending June 30, 1998. 13 (e) The sum of $1,306,600 is appropriated from federal receipts to the Department of 14 Health and Social Services for increased Medicaid school-based administrative claims 15 reimbursements for distribution to school districts for the fiscal year ending June 30, 1998. 16 (f) The sum of $12,018,400 is appropriated from federal receipts to the Department 17 of Health and Social Services, medical assistance, for entitlement growth and increased Indian 18 Health Service reimbursements for the fiscal year ending June 30, 1998. 19 (g) The sum of $886,667 is appropriated from federal receipts from Medicaid school- 20 based administrative reimbursements to the Department of Health and Social Services for costs 21 related to reducing the adoption caseload backlog. 22 (h) The unexpended and unobligated balance on June 30, 1998 of the appropriation 23 from the general fund made in sec. 100, ch. 123, SLA 1996, page 53, lines 18 - 21 (Yukon 24 Kuskokwim Health Corporation/State Community Health Services Building Design and 25 Construction - $7,333,000) is reappropriated to the Department of Health and Social Services 26 for design and construction of a Bethel public health clinic. 27 * Sec. 10. DEPARTMENT OF LAW. (a) The sum of $100,000 is appropriated from the 28 general fund to the Department of Law for additional costs of criminal trials for the fiscal year 29 ending June 30, 1998. 30 (b) The sum of $130,100 is appropriated from the general fund to the Department of 31 Law to pay judgments and claims against the state for the fiscal year ending June 30, 1998.

01 (c) The sum of $300,000 is appropriated from the general fund to the Department of 02 Law for additional costs in the criminal division associated with court challenges to the 03 statutes dealing with medical procedures and parental consent for abortions that became law 04 over the governor's veto. 05 (d) The sum of $2,500,000 is appropriated from the general fund to the Department 06 of Law for continuing costs that were underfunded in the operating budget for legal matters 07 involving oil and gas revenue due or paid to the state or state title to oil and gas land, and 08 proceedings before state and federal regulatory agencies involving the transportation of oil and 09 gas for the fiscal year ending June 30, 1998. 10 * Sec. 11. DEPARTMENT OF MILITARY AND VETERANS' AFFAIRS. The sum of 11 $100,000 is appropriated from federal receipts to the Department of Military and Veterans' 12 Affairs for the counterdrug program of the Alaska National Guard. 13 * Sec. 12. REALLOCATION OF MEDICAID STATE MATCH. (a) PURPOSE. The 14 purpose of this section is to make technical adjustments to the fiscal year 1998 Medicaid 15 budget to reflect the 59.8 percent federal match rate actually approved by Congress instead 16 of the 62 percent estimate available at the time the fiscal year 1998 budget was passed. It is 17 also to reallocate the $22,229,900 of fiscal year 1998 state matching money no longer needed 18 for Medicaid to other projects and services, set out in (c) and (d) of this section and in sec. 19 1(j) of this Act, that benefit children in a manner consistent with the basis on which Alaska's 20 congressional delegation secured the increased federal rate in Congress and on which the 21 governor secured the President's agreement not to veto the change. 22 (b) AMENDMENT OF APPROPRIATION. Section 29(a), ch. 98, SLA 1997 is 23 amended to read: 24  (a) The [SUBJECT TO (b) OF THIS SECTION, THE] sum of $7,770,100 25 [$30,000,000] is appropriated from the general fund to the Department of Health and 26 Social Services for medical assistance and allocated equally for Medicaid non-facility 27 and Medicaid facilities components, and the appropriation from federal receipts made 28 by sec. 39 of this Act to the Department of Health and Social Services for medical 29 assistance and allocated for the Medicaid non-facility and Medicaid facilities 30 components is reduced by a total of $7,770,100 [$30,000,000]. 31 (c) OPERATING APPROPRIATIONS FROM THE REALLOCATION OF

01 MEDICAID STATE MATCH. 02 (1) the sum of $119,300 is appropriated from the general fund to the 03 Department of Health and Social Services, division of family and youth services, to cover an 04 unanticipated reduction in federal Title XX block grant money used for child protection 05 services for the fiscal year ending June 30, 1998; 06 (2) the sum of $290,000 is appropriated from the general fund to the 07 Department of Health and Social Services, youth facilities services, for additional operating 08 costs relating to overcrowding in youth facilities for the fiscal year ending June 30, 1998; 09 (3) the sum of $355,600 is appropriated from the general fund to the 10 Department of Health and Social Services for additional operating costs relating to the foster 11 care augmented rate for special needs foster children for the fiscal year ending June 30, 1998; 12 (4) the sum of $2,000,000 is appropriated from the general fund to the Alaska 13 children's trust (AS 37.14.200(a)) to capitalize the trust; 14 (5) the sum of $1,467,000 is appropriated to the Department of Military and 15 Veterans' Affairs for the Alaska National Guard youth corps challenge program or similar 16 at-risk youth intervention programs from the following sources: 17 General fund $ 681,000 18 Federal receipts 786,000 19 (6) the sum of $100,000 is appropriated from the general fund to the 20 Department of Public Safety, council on domestic violence and sexual assault, to provide 21 training on domestic violence and sexual assault for school, medical, and other personnel; 22 (7) the sum of $1,303,600 is appropriated to the Department of Revenue, child 23 support enforcement agency, for grants for child support enforcement purposes for the fiscal 24 year ending June 30, 1998, from the following sources: 25 General fund match $ 65,200 26 Federal receipts 1,238,400 27 (8) the sum of $140,000 is appropriated from the general fund to the 28 Department of Revenue, child support enforcement agency, for non-reimbursable costs of 29 collecting support payments for children in state custody and to repay required reimbursements 30 for the fiscal year ending June 30, 1998. 31 (d) CAPITAL APPROPRIATIONS FROM THE REALLOCATION OF MEDICAID

01 STATE MATCH. 02 (1) the sum of $500,000 is appropriated from the general fund to the 03 Department of Community and Regional Affairs for health and safety capital improvements 04 to Head Start facilities in the state; 05 (2) the sum of $158,300 is appropriated from the general fund to the 06 Department of Education for power house demolition at Mt. Edgecumbe High School; 07 (3) the sum of $1,000,000 is appropriated from the general fund to the Office 08 of the Governor for statewide capital projects relating to Americans with Disabilities Act 09 compliance for state agencies; 10 (4) the sum of $200,000 is appropriated from the following sources to the 11 Department of Health and Social Services for Americans with Disabilities Act upgrades, 12 through competitive grants, for facilities that serve mental health trust beneficiaries: 13 General fund/mental health $ 100,000 14 Mental Health Trust Authority authorized receipts 100,000 15 (5) the sum of $450,000 is appropriated to the Department of Health and Social 16 Services, division of family and youth services, for technology improvements to support child 17 protection or prevention services from the following sources: 18 General fund match $ 225,000 19 Federal receipts 225,000 20 (6) the sum of $392,000 is appropriated from the general fund to the 21 Department of Health and Social Services for improvement of the alcohol and drug abuse 22 management information system; 23 (7) the sum of $800,000 is appropriated to the Department of Health and Social 24 Services for the implementation of the client data integration information system project from 25 the following sources: 26 General fund $ 400,000 27 Federal receipts 200,000 28 Mental Health Trust Authority 200,000 29 authorized receipts 30 (8) the sum of $400,000 is appropriated from the general fund to the 31 Department of Health and Social Services for computer and communication improvements for

01 the state public health nursing program; 02 (9) the sum of $410,200 is appropriated from the general fund to the 03 Department of Health and Social Services, division of family and youth services, for field 04 safety, office, and transportation equipment purchases, to support child protection or 05 prevention services; 06 (10) the sum of $450,000 is appropriated from the general fund to the 07 Department of Health and Social Services for repair and upgrade of the heat, ventilation, and 08 control system at McLaughlin Youth Facility; 09 (11) the sum of $1,705,000 is appropriated from the general fund to the 10 Department of Health and Social Services for design and construction of a Kenai public health 11 center; 12 (12) the sum of $1,518,300 is appropriated from the general fund to the 13 Department of Health and Social Services for construction of a youth detention facility in 14 Ketchikan; 15 (13) the sum of $5,297,000 is appropriated from the general fund to the 16 Department of Health and Social Services for construction of a detention unit and probation 17 offices at McLaughlin Youth Facility; 18 (14) the sum of $4,100,000 is appropriated from the general fund to the 19 Department of Health and Social Services for construction of a youth detention facility in the 20 Matanuska-Susitna Borough; 21 (15) the sum of $230,000 is appropriated from the general fund to the 22 Department of Military and Veterans' Affairs for repairs and upgrades to the Alaska National 23 Guard youth corps facility at Camp Carroll; 24 (16) the sum of $85,000 is appropriated from the general fund to the 25 Department of Public Safety, council on domestic violence and sexual assault, for the phase 26 three installation of the domestic violence and sexual assault information system; 27 (17) the sum of $100,000 is appropriated from the general fund to the 28 Department of Corrections, division of community corrections, for equipment and vehicles for 29 the sexual predator monitoring program; 30 (18) the sum of $800,000 is appropriated from the general fund to the 31 Department of Health and Social Services for inhalant prevention and treatment programs.

DEPARTMENT OF NATURAL RESOURCES. (a) The sum of $13,000,000 19 is appropriated from the general fund to the Department of Natural Resources for fire 20 suppression activities for the fiscal year ending June 30, 1998. 21 (b) The sum of $100,000 is appropriated from general fund program receipts to the 22 Department of Natural Resources for workload increases at the state recorder's office for the 23 fiscal year ending June 30, 1998. 24 (c) The sum of $155,000 is appropriated from the general fund to the Department of 25 Natural Resources for demolition and asbestos abatement at the old Eagle School site for the 26 fiscal year ending June 30, 1998. 27 (d) The sum of $118,500 is appropriated from federal receipts to the Department of 28 Natural Resources for geologic materials center deferred maintenance, sample storage 29 expansion, mining land records, mineral deposit database, and guide to Alaska mineral data 30 for the fiscal year ending June 30, 1998. 31 (e) The sum of $65,000 is appropriated from the agricultural revolving loan fund

01 (AS 03.10.040(a)) to the Department of Natural Resources for protection of collateral for loans 02 for the fiscal year ending June 30, 1998. 03 (f) The following amendments to ch. 98, SLA 1997 are made to change the source 04 of a portion of the appropriation for operations of the division of parks and outdoor recreation 05 in the Department of Natural Resources from general fund program receipts to general fund 06 receipts for the fiscal year ending June 30, 1998: 07 (1) sec. 41, ch. 98, SLA 1997, page 62, line 28, is amended to read: 08 General Fund Receipts 30,996,800 [30,836,800] 09 (2) sec. 41, ch. 98, SLA 1997, page 62, line 29, is amended to read: 10 General Fund/Program Receipts 7,296,300 [7,456,300] 11 * Sec. 15. RATIFICATIONS OF THE ACCOUNTING SYSTEM. (a) 23 The sum of $1,741,199 is appropriated from the general fund to the Alaska marine highway 24 system fund (AS 19.65.060(a)) for costs and lost revenue from refunded tickets resulting from 25 the 1997 Prince Rupert blockade of the M/V Malaspina. 26 (b) The sum of $518,100 is appropriated from the Alaska marine highway system fund 27 (AS 19.65.060(a)) to the Department of Transportation and Public Facilities, Alaska marine 28 highway system, Southeast vessel operations, for legal defense and other costs associated with 29 the 1997 Prince Rupert blockade of the M/V Malaspina for the fiscal year ending June 30, 30 1998. 31 (c) The sum of $600,000 is appropriated from the general fund to the Department of

01 Transportation and Public Facilities for capital improvements to the King Cove Harbor. 02 (d) The sum of $1,000,000 is appropriated from the general fund to the Department 03 of Transportation and Public Facilities for capital improvements to the Chignik Small Boat 04 Harbor. 05 (e) The sum of $2,000,000 is appropriated from the general fund to the Department 06 of Transportation and Public Facilities for capital improvements to the St. Paul Harbor. 07 * Sec. 19. UNIVERSITY OF ALASKA. (a) The sum of $606,500 is appropriated from 08 the general fund to the University of Alaska for settlement of a claim for the fiscal year 09 ending June 30, 1998. 10 (b) The sum of $1,700,000 is appropriated from university receipts to the University 11 of Alaska for planning and design costs for a multi-agency fisheries facility in Juneau. 12 * Sec. 20. COMMISSION ON JUDICIAL CONDUCT. The sum of $55,613 is 13 appropriated from the general fund to the Commission on Judicial Conduct for attorney fees 14 for the fiscal year ending June 30, 1998. 15 * Sec. 21. REPEALER. Section 29(b), ch. 98, SLA 1997 is repealed. 16 * Sec. 22. RETROACTIVITY. Sections 12(b) and 21 of this Act are retroactive to 17 January 1, 1998. 18 * Sec. 23. LAPSE PROVISIONS. (a) The appropriations made by secs. 1(e), 1(f), 1(i), 19 8(c), 9(h), 11, 12(d), 18(c) - (e), and 19(b) of this Act are for capital projects and lapse under 20 AS 37.25.020. 21 (b) The appropriations made by secs. 4(a), 6, 12(c)(4), and 18(a) of this Act are to 22 capitalize funds and do not lapse under AS 37.25.010. 23 (c) The unexpended and unobligated portions of the appropriations made by secs. 1(b), 24 9(g), 10(c), 12(c)(5), and 12(c)(6) of this Act lapse into the general fund June 30, 1999. 25 * Sec. 24. This Act takes effect immediately under AS 01.10.070(c).
