01 "An Act requiring that the cost of contraceptives and related health care services                                      
02 be included in health insurance coverage."                                                                              
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  SHORT TITLE.  This Act may be known as the Contraceptive Coverage Act                                
05 of 1998.                                                                                                                
06    * Sec. 2.  AS 21.42 is amended by adding a new section to read:                                                    
07  Sec. 21.42.390.  Coverage for contraceptives.  (a)  Except for a fraternal                                          
08 benefit society, a policy issued to an individual, or a qualified church-controlled                                     
09 organization with a religious-based objection, a health care insurer that offers, issues                                
10 for delivery, delivers, or renews in this state a health care insurance plan shall provide                              
11 coverage for contraceptives and related health care services.  The coverage required                                    
12 under this section is subject to standard policy provisions applicable to other benefits,                               
13 including deductible or copayment provisions.                                                                           
14  (b)  In this section,                                                                                                 

01   (1)  "contraceptives" includes an appliance, a drug, or a medicinal                                                  
02 preparation intended for the prevention of conception;                                                                  
03   (2)  "health care services" includes consultations, examinations,                                                    
04 procedures, and services medically necessary to prescribe or administer contraceptives;                                 
05   (3)  "qualified church-controlled organization" has the meaning given                                                
06 in 26 U.S.C. 3121(w)(3).
