00CS FOR SENATE BILL NO. 314(STA) 01 "An Act relating to brewery, brewpub, wholesale, winery, bottling works, 02 distillery, and restaurant or eating place liquor licenses." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 04.11.135(a) is amended to read: 05  (a) A brewpub license authorizes the holder of a beverage dispensary license 06 to 07  (1) manufacture on premises licensed under the beverage dispensary 08 license not more than 75,000 gallons of beer in a calendar year; [AND] 09  (2) sell beer manufactured on premises licensed under the beverage 10 dispensary license for consumption only on the licensed premises; 11  (3) sell beer manufactured on the premises licensed under the 12 beverage dispensary license in quantities of not more than five gallons per day to 13 an individual who is present on the licensed premises; and 14  (4) provide a small sample of the brewpub's beer manufactured on

01 the premises free of charge unless prohibited by AS 04.16.030. 02 * Sec. 2. AS 04.11 is amended by adding a new section to read: 03  Sec. 04.11.455. RESTRICTION ON COMBINATION OF LICENSES. (a) 04 A person may not hold a wholesale, brewery, winery, bottling works, or distillery 05 license at the same time that the person holds a restaurant or eating place license if, 06 after issuance of the license, there would be more than one person holding a restaurant 07 or eating place license in combination with a wholesale, brewery, winery, bottling 08 works, or distillery license for each 30,000 in population or fraction of population 09 within a radius of 10 miles from the location of premises being licensed. 10  (b) If the ownership of a license subject to the restriction imposed under (a) 11 of this section is transferred to another person and the person transferring the license 12 receives compensation for the transfer in excess of the fee paid for the license under 13 AS 04.11, the person transferring the license shall pay to the state 75 percent of the 14 amount received in excess of the fee paid under AS 04.11.
