00CS FOR SENATE BILL NO. 285(FIN) 01 "An Act relating to management of discrete salmon stocks and to a salmon 02 management assessment; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. PURPOSE. This Act requires the Board of Fisheries to adopt and implement 05 a discrete salmon stock management policy that is consistent with the sustained yield of wild 06 salmon stocks. This Act also provides a means to offset the costs incurred by the state in 07 adopting and implementing a discrete salmon stock management policy. 08 * Sec. 2. AS 16.05 is amended by adding a new section to article 5 to read: 09 Sec. 16.05.735. DISCRETE SALMON STOCK MANAGEMENT. (a) The 10 Board of Fisheries shall adopt and implement by regulation a policy for the 11 management of discrete salmon stocks that is consistent with sustained yield of wild 12 salmon stocks. The board shall adopt and implement a discrete stock management 13 policy by 14 (1) January 1, 2001, for
01 (A) all sockeye salmon and chum salmon stocks taken in each 02 of the Cook Inlet, Kodiak, Aleutian Islands and Alaska Peninsula, and 03 Kuskokwim salmon fishery management areas; and 04 (B) all chinook salmon stocks taken in each of the Cook Inlet, 05 Copper River, and Kodiak salmon fishery management areas; 06 (2) January 1, 2006, for 07 (A) all chinook salmon stocks taken in each of the Southeastern 08 Alaska, Yakutat, Aleutian Islands and Alaska Peninsula, Bristol Bay, 09 Kuskokwim, and Yukon-Northern salmon fishery management areas; and 10 (B) all coho salmon stocks taken in each of the Southeastern 11 Alaska, Yakutat, Cook Inlet, Kodiak, Aleutian Islands and Alaska Peninsula, 12 Bristol Bay, Kuskokwim, and Yukon-Northern salmon fishery management 13 areas; 14 (3) January 1, 2011, for all pink salmon stocks taken in each of the 15 Southeastern Alaska, Yakutat, Prince William Sound, Kodiak, Chignik, and Aleutian 16 Islands and Alaska Peninsula salmon fishery management areas. 17 (b) The Department of Fish and Game shall 18 (1) consult with the Board of Fisheries to determine what salmon stock 19 information would be most useful to the board; 20 (2) determine the stock composition by river of origin for each existing 21 mixed stock salmon fishery; in addition to identifying the discrete salmon stocks 22 originating in the state, the department shall identify non-Alaska stocks of Asian origin 23 and non-Alaska stocks originating elsewhere in North America that are taken in each 24 mixed stock fishery; the department shall annually provide the stock composition data 25 collected under this paragraph to the board; 26 (3) develop escapement objectives, based, at the minimum, on the 27 availability of spawning and rearing habitat and average production, for each discrete 28 salmon stock where technically feasible; 29 (4) develop the ability to project escapements for each discrete salmon 30 stock in order to provide the board with the information necessary to perform its duties 31 under this section; the department shall annually provide projections of escapement for
01 each discrete salmon stock to the board in a timely manner; and 02 (5) annually provide to the board in a timely manner the stock 03 identification data that are necessary to manage mixed stock fisheries before the fishing 04 season for those fisheries begins. 05 (c) In this section, 06 (1) "discrete salmon stock" means a population of a species of salmon 07 that spawns in the 08 (A) Noatak River or Kobuk River; 09 (B) Yukon River; 10 (C) Kuskokwim River; 11 (D) Togiak River; 12 (E) Igushik River, Wood River, or Nushagak River; 13 (F) Kvichak River; 14 (G) Naknek River; 15 (H) Egegik River; 16 (I) Ugashik River; 17 (J) Chignik River; 18 (K) Ayakulik River; 19 (L) Fraser River; 20 (M) Karluk River; 21 (N) Kasilof River; 22 (O) Kenai River; 23 (P) Susitna River; 24 (Q) Coghill-Eshamy River; 25 (R) Copper River or Bering River; 26 (S) Alsek River; 27 (T) Situk River; 28 (U) Chilkat River; 29 (V) Chilkoot River; 30 (W) Taku River; or 31 (X) Stikine River;
01 (2) "river of origin" means the river in which a discrete salmon stock 02 spawns. 03 * Sec. 3. AS 16.05.340 is amended by adding a new subsection to read: 04 (g) In addition to the license fees set under (a) of this section, a salmon 05 management surcharge of $1 shall be collected on each sport fishing license sold under 06 (a)(1), (5), (6), (7), (8), or (10). The amount of the surcharge collected under this 07 subsection shall be deposited into the fish and game fund. The legislature may 08 appropriate money collected under this subsection to the Department of Fish and Game 09 for the discrete stock management research and data collection program under 10 AS 16.05.735. 11 * Sec. 4. AS 16.05.480 is amended by adding a new subsection to read: 12 (d) In addition to the license fee set under (a) of this section for a crewmember 13 fishing license, a management surcharge of $20 shall be collected at the time of 14 issuance of a crewmember fishing license. The amount of the surcharge collected 15 under this subsection shall be deposited into the general fund. The legislature may 16 appropriate money collected under this subsection to the Department of Fish and Game 17 for the discrete stock management research and data collection program under 18 AS 16.05.735. 19 * Sec. 5. AS 16.43.160 is amended by adding a new subsection to read: 20 (e) In addition to the amounts collected under (a) - (d) of this section, the 21 commission shall collect, at the time of renewal of an entry permit or interim-use 22 permit for a salmon fishery, a management surcharge of $20. The amount of the 23 surcharge collected under this subsection shall be deposited into the general fund. The 24 legislature may appropriate money collected under this subsection to the Department 25 of Fish and Game for the discrete stock management research and data collection 26 program under AS 16.05.735. 27 * Sec. 6. Sections 3 - 5 of this Act take effect January 1, 1997.
