01 "An Act relating to access to extracurricular school programs by students who                                           
02 are not attending public schools."                                                                                      
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 14.30 is amended by adding a new section to read:                                                   
05           Sec. 14.30.025.  NONPUBLIC SCHOOL STUDENT PARTICIPATION IN                                                   
06 PUBLIC SCHOOL PROGRAMS.  (a)  A governing body may not deny a student who                                               
07 resides within the school district but is not in attendance within the school district the                              
08 right to participate in extracurricular activities occurring in the school district if the                              
09 student                                                                                                                 
10   (1)  is receiving academic education as permitted under                                                              
11 AS 14.30.010(b); and                                                                                                    
12   (2)  otherwise meets all school district eligibility requirements for                                                
13 participation in the activity that are applicable to a student who is in attendance in the                              
14 school district.                                                                                                        



01  (b)  In this section,                                                                                                 
02   (1)  "extracurricular activities" include drama, debate, music, band, and                                            
03 athletic activities;                                                                                                    
04   (2)  "school district" means a municipal school district or a regional                                               
05 educational attendance area.
