00CS FOR SENATE BILL NO. 145(JUD) 01 "An Act relating to municipal regulation of certain aspects of charitable gaming; 02 requiring the reporting of winners of prizes of $50 or more from a bingo or 03 pull-tab game to the Department of Health and Social Services to ensure that 04 recipients of services or assistance are reporting those winnings and are eligible 05 for services or assistance; relating to the awarding of those prizes; prohibiting 06 charitable gaming permittees, operators, and registered vendors from cashing state 07 public assistance checks; and relating to penalties for violations of the charitable 08 gaming laws." 09 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 10 * Section 1. AS 05.15.124 is amended to read: 11  Sec. 05.15.124. MUNICIPAL REGULATION OF OPERATORS OR 12 VENDORS. A municipality may by ordinance 13  (1) prohibit an operator or a vendor from conducting activities under this 14 chapter within the municipality;

01  (2) limit the number of permittees and licensees allowed to conduct 02 bingo and pull-tab games within the municipality, but not to less than the number 03 permitted or licensed on the date of the ordinance; 04  (3) limit the hours of operation of bingo and pull-tab games and the 05 number of sessions of bingo that may be conducted under a permit each week 06 within the municipality. 07 * Sec. 2. AS 05.15 is amended by adding a new section to read: 08  Sec. 05.15.175. IDENTIFICATION AND REPORTING OF WINNERS OF 09 BINGO AND PULL-TAB PRIZES OF $50 OR MORE. (a) Notwithstanding another 10 provision of this chapter, a permittee, operator, or vendor may not turn over a prize of 11 $50 or more from a bingo or pull-tab game to a person entitled to that prize unless the 12 person presents proper picture identification, the permittee, operator, or vendor records 13 the person's name and social security number or date of birth on a receipt for the prize, 14 and the person signs the receipt and returns it to the permittee, operator, or vendor. The 15 receipt must be in a form approved by the department. 16  (b) A permittee, operator, or vendor shall provide copies of receipts required for 17 prizes of $50 or more from bingo games and from pull-tab games under this section to 18 the Department of Health and Social Services at times and for periods set by the 19 Department of Health and Social Services. 20 * Sec. 3. AS 05.15.180 is amended by adding a new subsection to read: 21  (h) A permittee, operator, or registered vendor may not cash a check issued by 22 the state to a person for financial assistance under AS 47 other than AS 47.45. 23 * Sec. 4. AS 05.15.680(a) is amended to read: 24  (a) A person who knowingly violates or aids or solicits a person to violate this 25 chapter is guilty of a 26  (1) violation, and may be fined not more than $5,000, for the first 27 offense; or 28  (2) [AND A] class B misdemeanor, and may be fined not more than 29 $10,000 and may be imprisoned as provided in AS 12.55, for the second and each 30 subsequent offense. 31 * Sec. 5. AS 44.29.020 is amended by adding a new subsection to read:

01  (c) The department shall review charitable gaming prize receipts for pull-tab and 02 bingo games received under AS 05.15.175 to verify that recipients of services provided 03 by the department are fully and completely reporting income received from charitable 04 gaming activities and to ensure that those recipients are eligible for the services or 05 assistance provided by the department. 06 * Sec. 6. AS 05.15.187(i) is repealed.
