00SENATE BILL NO. 58 01 "An Act restricting the use of the title `industrial hygienist' and related titles and 02 initials." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 45.50.471(b) is amended by adding a new paragraph to read: 05  (38) violating AS 45.50.477(a) - (c). 06 * Sec. 2. AS 45.50 is amended by adding a new section to read: 07  Sec. 45.50.477. USE OF TITLES RELATING TO INDUSTRIAL HYGIENE. 08 (a) A person may not use the title "industrial hygienist," the initials "I.H.," another 09 term that includes the phrase "industrial hygiene" or similar words, or represent to the 10 public that the person is an industrial hygienist, unless the person has a baccalaureate 11 or graduate degree in industrial hygiene, biology, chemistry, engineering, physics, or 12 a closely related physical or biological science from a college or university accredited 13 by a national or regional accreditation association recognized by the Council on 14 Postsecondary Accreditation and has acquired competence in industrial hygiene through

01 special studies sufficient to provide the person with the ability and competence to 02  (1) anticipate and recognize the environmental factors and stresses 03 associated with work and work operations and to understand their effects on people 04 and their well-being; 05  (2) evaluate, on the basis of training and demonstrated work experience 06 and with the aid of quantitative measurement techniques, the magnitude of the factors 07 and stresses identified under (1) of this subsection in terms of their ability to impair 08 human health and well-being; and 09  (3) prescribe methods to prevent, eliminate, control, or reduce the 10 factors and stresses identified under (a) of this subsection when necessary to alleviate 11 their effects. 12  (b) A person may not use the title "industrial hygienist in training," the initials 13 "I.H.I.T.," another term involving the phrase "industrial hygiene" or a variation of 14 those words, or represent to the public that the person is an industrial hygienist in 15 training, unless the person is certified as an industrial hygienist in training by the 16 American Board of Industrial Hygiene. 17  (c) A person may not use the title "certified industrial hygienist," the initials 18 "C.I.H.," another term involving the phrase "industrial hygiene" or a variation of those 19 words, or represent to the public that the person is a certified industrial hygienist 20 unless the person is certified as a certified industrial hygienist by the American Board 21 of Industrial Hygiene. 22  (d) A state or local government agency may not prohibit or restrict the practice 23 of industrial hygiene by a qualified individual who complies with this section except 24 to the extent that a state statute allows the agency to regulate a specific activity that 25 may be included in the practice of industrial hygiene. 26  (e) In this section, "industrial hygiene" means the science and practice devoted 27 to the anticipation, recognition, evaluation, and control of environmental factors and 28 stresses arising in or from the workplace that may cause illness, impaired health or 29 well-being, or significant discomfort among workers and may also affect persons 30 outside the workplace.
