00HOUSE BILL NO. 510 01 "An Act relating to occupational licensing fees and regulatory costs for 02 occupational licensing functions; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.01.065(c) is amended to read: 05  (c) The department shall establish fee levels under (a) of this section so that 06 the total amount of fees collected for an occupation approximately equals the actual 07 regulatory costs for the occupation. However, in calculating the actual regulatory 08 costs for an occupation, the department shall allocate to the occupation a prorated 09 share of total enforcement costs so that the amount allocated to each occupation 10 bears the same relationship to total enforcement costs as the number of the 11 occupation's licensees bears to the total number of licensees in all occupations 12 regulated under this title. The department shall annually review each fee level to 13 determine whether the regulatory costs of each occupation are approximately equal to 14 fee collections related to that occupation. If the review indicates that an occupation's

01 fee collections and regulatory costs are not approximately equal, the department shall 02 calculate fee adjustments and adopt regulations under (a) of this section to implement 03 the adjustments. In January of each year, the department shall report on all fee levels 04 and revisions for the previous year under this subsection to the office of management 05 and budget. If a board regulates an occupation covered by this chapter, the department 06 shall consider the board's recommendations concerning the occupation's fee levels and 07 regulatory costs before revising fee schedules to comply with this subsection. In this 08 subsection, 09  (1) "regulatory costs" means costs of the department that are 10 attributable to regulation of an occupation plus 11  (A) [(1)] all expenses of the board that regulates the occupation 12 if the board regulates only one occupation; 13  (B) [(2)] the expenses of a board that are attributable to the 14 occupation if the board regulates more than one occupation; 15  (2) "total enforcement costs" means the total of all costs incurred 16 by the department and the boards for legal, investigative, and hearing functions 17 for occupations regulated under this title. 18 * Sec. 2. This Act takes effect July 1, 1996.
