00CS FOR HOUSE BILL NO. 405(STA) 01 "An Act relating to the Board of Examiners in Optometry; relating to licensure 02 of dispensing opticians; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.03.010(c)(19) is amended to read: 05  (19) Board of Examiners in Optometry (AS 08.72.010) -- June 30, 2002 06 [1996]; 07 * Sec. 2. AS 08.71.230 is amended to read: 08  Sec. 08.71.230. EXEMPTIONS FROM AND LIMITATIONS ON THE 09 APPLICATION OF THIS CHAPTER. This chapter may not be construed to 10  (1) limit or restrict a licensed physician or optometrist, or an employee 11 to whom a licensed physician or optometrist has delegated duties under 12 AS 08.72.110(a), from the practices enumerated in this chapter, and each licensed 13 physician and optometrist has all the rights and privileges that [WHICH] may accrue 14 under this chapter to dispensing opticians licensed under it;

01  (2) prohibit an unlicensed person from performing mechanical work 02 upon inert matter in an optical office, laboratory, or shop; 03  (3) prohibit an unlicensed person from engaging in the sale of 04 eyeglasses, spectacles, magnifying glasses, goggles, sunglasses, telescopes, binoculars, 05 or any like articles that [WHICH] are completely preassembled and sold only as 06 merchandise; 07  (4) authorize or permit a licensee under this chapter to hold out as 08 being able to, or to offer to, or to attempt by any means, to refract or exercise eyes, 09 diagnose, treat, correct, relieve, operate, or prescribe for any human ailment, 10 deficiency, deformity, disease, or injury. 11 * Sec. 3. AS 08.72.110(a) is amended to read: 12  (a) A person may not practice, attempt to practice, or offer to practice 13 optometry without first obtaining a license from the board, except that a person 14 employed by and under the direct supervision of a licensed physician or licensed 15 optometrist may perform duties in the licensee's office as delegated by the 16 licensee. 17 * Sec. 4. AS 08.72.150 is amended to read: 18  Sec. 08.72.150. APPLICATION FOR EXAMINATION AND ISSUANCE OF 19 LICENSE. An applicant shall apply for the examination by filing an application with 20 the department together with the examination fee by the deadline established by the 21 department in regulations [AT LEAST 15 DAYS BEFORE THE EXAMINATION]. 22 Upon successful completion of the examination by the applicant and payment of the 23 license fee, the board shall issue a license to the successful applicant. The applicant 24 may practice optometry in the state upon receipt of the license. 25 * Sec. 5. AS 08.72.125, 08.72.140(1), and 08.72.140(2) are repealed. 26 * Sec. 6. This Act takes effect immediately under AS 01.10.070(c).
