01 "An Act relating to managed care for recipients of medical assistance; and                                              
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  MANAGED-CARE PROGRAM.  (a)  The Department of Health and Social                                        
05 Services shall develop managed-care or capitated health care systems for recipients of medical                          
06 assistance under AS 47.07 under which the department would contract with one or more                                    
07 persons for the management of comprehensive health services for the recipients.  The contract                           
08 may provide for a fixed monetary or capitated amount for each recipient in a geographically                             
09 or otherwise defined population of recipients.                                                                          
10  (b) A system developed under (a) of this section may require that a recipient of                                       
11 medical assistance under AS 47.07 must participate in a managed-care system in order to                                 
12 remain eligible for medical assistance under AS 47.07.  This participation requirement may                              
13 be based on geographical, financial, social, medical, and other factors that the Department of                          
14 Health and Social Services determines are relevant to the development and efficient                                     

01 management of the managed-care system.                                                                                  
02  (c)  Upon developing a system required under (a) of this section, the Department of                                    
03 Health and Social Services shall submit draft legislation of the proposed system to the                                 
04 legislature on the first day of the First Regular Session of the Twentieth Alaska State                                 
05 Legislature.                                                                                                            
06    * Sec. 2.  This Act takes effect immediately under AS 01.10.070(c).
