01 "An Act prohibiting certain retail sales of cigarettes."                                                                
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  PURPOSE.  It is the purpose of this Act to prohibit retail sales of single                             
04 cigarettes, except when packaged singly by the manufacturer.                                                            
05    * Sec. 2.  AS 11.76 is amended by adding a new section to read:                                                      
06  Sec.  11.76.108.  PROHIBITED RETAIL SALES OF CIGARETTES.  (a) A                                                       
07 person who holds a business license endorsement under AS 43.70.075, or an agent or                                      
08 employee of the person, may not sell cigarettes to another person unless the cigarettes                                 
09 are sold in the manufacturer's original packaging material.  In this subsection,                                        
10 "packaging material" means a cigarette pack, carton, or box.                                                            
11  (b)  A person who violates this section is guilty of a violation.
