01 "An Act relating to the offense of possession of tobacco by a minor."                                                   
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 11.76.105(a) is amended to read:                                                                    
04  (a)  A person under 19 years of age may not knowingly possess a cigarette, a                                          
05 cigar, tobacco, or a product containing tobacco in this state.  This subsection does not                                
06 apply to a person                                                                                                       
07   (1)  who is a prisoner at an adult correctional facility; or                                                      
08   (2)  working in cooperation with a peace officer to make a                                                           
09 controlled purchase of a product containing tobacco in order to obtain evidence                                         
10 of the commission of a violation of AS 11.76.100; however, if the person is under                                       
11 18 years of age and is a person for whom the disabilities of minority have not                                          
12 been removed under AS 09.55.590 and who has not arrived at the age of majority                                          
13 under AS 25.20.020, the provisions of this paragraph do not apply unless the                                            
14 person has first obtained the approval of the person's parent or guardian to                                            

01 participate in the controlled purchase of a product containing tobacco.
