01 "An Act prohibiting the Department of Environmental Conservation from including                                         
02 an administrative fine in certain consent orders or other agreements."                                                  
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 44.46 is amended by adding a new section to read:                                                   
05  Sec. 44.46.022.  ADMINISTRATIVE FINE PROHIBITED.  Notwithstanding                                                     
06 AS 44.46.020 and AS 46.03, the Department of Environmental Conservation may not                                         
07 include in a consent order or other agreement a provision that requires the other party                                 
08 to the agreement to pay a fine determined by the department for a violation or alleged                                  
09 violation under AS 46.03.                                                                                               
10    * Sec. 2.  APPLICABILITY.  This Act applies to a consent order or other agreement                                    
11 entered into, renewed, or extended on or after the effective date of this Act.
