00SENATE CS FOR CS FOR HOUSE BILL NO. 268(FIN) am S 01 "An Act making and amending appropriations; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Federal or other program receipts as defined under AS 37.05.146 that exceed 05 the amount appropriated by sec. 127 of this Act are appropriated conditioned upon compliance 06 with the program review provisions of AS 37.07.080(h). 07 * Sec. 2. The sum of $18,300,000 is appropriated from the general fund to the municipal 08 capital project matching grant fund (AS 37.06.010(b)) in the Department of Administration 09 to provide grants to municipalities under the municipal capital project matching grant program. 10 * Sec. 3. The sum of $1,700,000 is appropriated from the general fund to the 11 unincorporated community capital project matching grant fund (AS 37.06.020(b)) in the 12 Department of Community and Regional Affairs to provide grants to unincorporated 13 communities under the unincorporated community capital project matching grant program. 14 * Sec. 4. (a) An amount equal to the sum of the balances of the individual grant accounts

01 established under AS 37.06.010 as of close of business on June 30, 1995, multiplied by the 02 average percentage rate at which interest is received by other accounts in the state's general 03 investment fund that receive interest during fiscal year 1995, is appropriated from the general 04 fund to the municipal capital project matching grant fund (AS 37.06.010). 05 (b) The appropriation made by (a) of this section is allocated pro rata to the individual 06 grant accounts established under AS 37.06.010 according to the portion of the sum of the 07 balances of those individual grant accounts as of close of business on June 30, 1995, that is 08 attributable to each individual grant account. 09 * Sec. 5. (a) An amount equal to the sum of the balances of the individual grant accounts 10 established under AS 37.06.020 as of close of business on June 30, 1995, multiplied by the 11 average percentage rate at which interest is received by other accounts in the state's general 12 investment fund that receive interest during fiscal year 1995, is appropriated from the general 13 fund to the unincorporated community capital project matching grant fund (AS 37.06.020). 14 (b) The appropriation made by (a) of this section is allocated pro rata to the individual 15 grant accounts established under AS 37.06.020 according to the portion of the sum of the 16 balances of those individual grant accounts as of close of business on June 30, 1995, that is 17 attributable to each individual grant account. 18 * Sec. 6. (a) Contingent upon an agreement by the federal government to match the 19 amount appropriated under this section on a dollar-for-dollar basis, the sum of $8,650,000, or 20 a lesser amount equal to the amount the federal government agrees to match on a dollar-for-dollar basis, is 21 appropriated from the general fund to the Department of Education for the 22 construction or upgrade of elementary school facilities at Aurora Elementary School, Ursa 23 Minor Elementary School, and Eielson Air Force Base. 24 (b) If the Department of Education has not entered into an agreement with the federal 25 government that the federal government will match the maximum amount appropriated under 26 (a) of this section on a dollar-for-dollar basis, the portion of the appropriation made by (a) of 27 this section that is not subject to an agreement with the federal government is repealed 28 June 30, 1996. 29 (c) Subject to (b) of this section, if the Department of Education has entered into an 30 agreement with the federal government that the federal government will match the amount 31 appropriated under (a) of this section on a dollar-for-dollar basis, the appropriation made by

01 (a) of this section lapses under AS 37.25.020. 02 * Sec. 7. The sum of $2,000,000 is appropriated from the Alaska marine highway system 03 vessel replacement fund (AS 37.05.550) to the Department of Transportation and Public 04 Facilities for marine highway system improvements/overhaul. 05 * Sec. 8. (a) Subject to the condition set out in (b) of this section, an amount not to 06 exceed the unexpended matching balances of the appropriations set out in the Office of 07 Management and Budget Capital Authorization Status Report as of May 1, 1995, for highway 08 planning, design, construction, and related activities, is appropriated from the sources of those 09 appropriations to the Department of Transportation and Public Facilities for the purpose of 10 highway planning, design, construction, and related activities. 11 (b) Money may be expended under the appropriation made by (a) of this section only 12 to the extent that the Department of Transportation and Public Facilities records a reduction 13 of expenditure authorization with the Department of Administration for an appropriation for 14 highway planning, design, construction, and related activities, set out in the Office of 15 Management and Budget Capital Authorization Status Report as of May 1, 1995. 16 * Sec. 9. (a) Subject to the condition set out in (b) of this section, an amount not to 17 exceed the unexpended matching balances of the appropriations set out in the Office of 18 Management and Budget Capital Authorization Status Report as of May 1, 1995, for aviation 19 planning, design, construction, and related activities, is appropriated from the sources of those 20 appropriations to the Department of Transportation and Public Facilities for the purpose of 21 aviation planning, design, construction, and related activities. 22 (b) Money may be expended under the appropriation made by (a) of this section only 23 to the extent that the Department of Transportation and Public Facilities records a reduction 24 of expenditure authorization with the Department of Administration for an appropriation for 25 aviation planning, design, construction, and related activities, set out in the Office of 26 Management and Budget Capital Authorization Status Report as of May 1, 1995. 27 * Sec. 10. The sum of $100,000 is appropriated from the general fund to the Department 28 of Natural Resources, state land reforestation fund (AS 41.17.300). 29 * Sec. 11. (a) Subject to the conditions set out in (c) of this section, the sum of $930,078 30 is appropriated from the appropriate individual grant accounts in the municipal capital project 31 matching fund (AS 37.06.010) for payment as grants under AS 37.06.010 to the following

01 (c) The appropriations made by (a) and (b) of this section are made contingent on the 02 municipality or unincorporated community complying before July 1, 1996, with the 03 requirements, other than the deadlines, set out in AS 37.06. 04 * Sec. 12. The unexpended and unobligated balance of the appropriation made in sec. 19, 05 ch. 79, SLA 1993, page 48, line 12 (City and Borough of Juneau - Mount Roberts Marina - 06 $3,000,000) is appropriated to the following agencies for the following purposes in the 07 amounts listed: 08 PURPOSE APPROPRIATION 09 University of Alaska Juneau residence hall $1,800,000 10 Department of Administration 11 as a grant under AS 37.05.315 to the City and Borough of Juneau for the Back 12 Loop/University of Alaska sewer and water project. $ 600,000 13 Department of Administration - statewide 14 satellite communications project $ 400,000 15 * Sec. 13. The sum of $1,050,000 is appropriated from the following fund sources in the 16 amount listed to the following agencies for costs relating to the integration of the state's 17 criminal justice computer systems to improve the quality, coordination, and access to criminal 18 history information: 19 APPROPRIATION 20 AGENCY FUND SOURCE AMOUNT 21 Department of 22 Administration General Fund $ 300,000 23 Department of Corrections Federal Receipts 750,000 24 * Sec. 14. (a) The sum of $4,000,000 is appropriated from the Southeast energy fund 25 (AS 42.45.040) to the Department of Administration for payment as a grant under 26 AS 37.05.315 to the City of Ketchikan, Ketchikan Public Utility, for planning, design, and 27 construction of a power transmission intertie between Swan Lake and Tyee Lake hydroelectric 28 projects. 29 (b) It is the intent of the legislature that the administration negotiate in good faith the 30 transfer of the power projects described in the initial project to the communities served by 31 them during the fiscal year ending June 30, 1996.

01 (c) In this section, "initial project" means the power project described as the initial 02 project in AS 44.83.398(a), consisting of the Tyee Lake, Swan Lake, Solomon Gulch, and 03 Terror Lake hydroelectric facilities, which are considered for purposes of AS 44.83.398 to 04 be one power project. 05 * Sec. 15. (a) The sum of $1,000,000 is appropriated from federal receipts from the 06 National Marine Fisheries Service to the Department of Fish and Game for the following 07 purposes in the amounts listed: 08 PURPOSE AMOUNT 09 (1) Kenai River drainage expedited permit processing 10 and coordinating center in space provided by the 11 Kenai Peninsula Borough $ 100,000 12 (2) Kenai River drainage habitat restoration project 13 identification and prioritization 30,000 14 (3) Kenai River drainage habitat restoration demonstration 15 projects and grants 870,000. 16 (b) The funds appropriated under (a)(3) of this section may be transferred to the 17 Department of Administration for grants approved by the Department of Fish and Game to the 18 Kenai Peninsula Borough for Kenai River drainage habitat restoration demonstration projects 19 on private land. 20 * Sec. 16. The unexpended and unobligated balance of the disaster relief fund 21 (AS 26.23.300) on June 30, 1995, lapses June 30, 1996, into the funds from which it was 22 appropriated. 23 * Sec. 17. (a) The sum of $350,000,000 is appropriated from all unrestricted mortgage 24 loan interest payments and all other unrestricted receipts, including mortgage loan commitment 25 fees, to the Alaska Housing Finance Corporation for the corporation's loan programs for which 26 the corporation does not provide a subsidy. 27 (b) The sum of $50,000,000 is appropriated from all unrestricted mortgage loan 28 interest payments and all other unrestricted receipts, including mortgage loan commitment 29 fees, to the Alaska Housing Finance Corporation for the corporation's multi-family housing 30 loans and the corporation's housing loan programs and housing loan projects for which the 31 corporation provides a subsidy from the corporation's arbitrage earnings.

01 * Sec. 18. Notwithstanding any prior expenditure authorization to the contrary, funds 02 appropriated by this Act, by another Act enacted by the First Session of the Nineteenth Alaska 03 State Legislature, or by another Act enacted by a prior legislature may not be used to extend 04 Runway 14/32 at the Anchorage International Airport. 05 * Sec. 19. The unexpended and unobligated balance in the Alaska Science and Technology 06 Endowment earnings reserve, after subtraction of the amount appropriated from the earnings 07 reserve in a version of HB 100 that is enacted into law in 1995and the amount appropriated 08 by sec. 115, page 57, line 24 of this Act, is appropriated to the Alaska Science and 09 Technology Foundation for grants for the fiscal year ending June 30, 1996. 10 * Sec. 20. The sum of $589,000 is appropriated from the general fund to the Department 11 of Natural Resources, division of forestry, during the fiscal year ending June 30, 1995, for the 12 following salvage timber harvests in the amounts stated: 13 PURPOSE APPROPRIATION 14 AMOUNT 15 Prince of Wales Island salvage timber harvest 6,000 16 Haines salvage timber harvest 10,000 17 Nenana Goldstream salvage timber harvest 275,000 18 Kelsall River salvage timber harvest 85,000 19 Delta salvage timber harvest 213,000. 20 * Sec. 21. The unexpended and unobligated balance of the appropriation made in sec. 3, 21 ch. 83, SLA 1993, and allocated on page 4, line 17 (Petersburg Elementary School code 22 upgrades - $105,000) is reappropriated to the school construction grant fund for payment as 23 a grant under AS 14.11.005 by the Department of Education to Petersburg City Schools for 24 the middle school/high school shop addition. 25 * Sec. 22. The unexpended and unobligated balance of the appropriation made in sec. 21, 26 ch. 79, SLA 1993, page 74, lines 7 - 8 (Angoon town hall renovation - $70,000) is 27 reappropriated to the Department of Administration for payment as a grant under 28 AS 37.05.315 to the City of Angoon for repairs and renovation of the community services 29 building. 30 * Sec. 23. The unexpended and unobligated balance of the appropriation made in sec. 139, 31 ch. 208, SLA 1990, page 103, line 6 (Larsen Bay boat harbor project construction - $222,000)

01 is reappropriated to the Department of Administration for payment as a grant under 02 AS 37.05.315 to the City of Larsen Bay for the boat harbor construction project. 03 * Sec. 24. (a) The unexpended and unobligated balance of the appropriation made in sec. 04 21, ch. 79, SLA 1993, page 76, line 6 (City of Port Lions water main to boat harbor - 05 $200,000) is reappropriated to the Department of Administration for payment as grants under 06 AS 37.05.315 to the City of Port Lions for the following purposes and in the following 07 amounts: 08 PURPOSE GRANT AMOUNT 09 City of Port Lions community hall $175,000 10 Harbor water main feasibility study 25,000 11 (b) If the amount available from the reappropriation of sec. 21, ch. 79, SLA 1993, 12 page 76, line 6, in (a) of this section is less than $200,000, then the grants made by (a) of this 13 section shall be reduced in proportion to the amount of the shortfall. 14 * Sec. 25. (a) The unexpended and unobligated balances of the appropriation made in 15 sec. 154, ch. 5, FSSLA 1992, page 88, line 17 (Homer Intermediate School boiler replacement 16 - $95,600) and the appropriation made in sec. 3, ch. 83, SLA 1993, and allocated on page 4, 17 lines 24 - 25 (Soldotna Elementary gym roof replacement - $113,400) are reappropriated to 18 the Department of Administration for payment as grants under AS 37.05.315 to the Kenai 19 Peninsula Borough for the following projects in the following amounts: 20 PROJECT APPROPRIATION 21 Chapman Elementary School re-roof $ 45,000 22 Homer Junior High School lockers replacement 7,000 23 Seward High School re-roof 30,450 24 Sterling Elementary School classroom heaters upgrade 14,000 25 School district administration carpet replacement 12,600. 26 (b) If the amount available from the reappropriation in (a) of this section of sec. 154, 27 ch. 5, FSSLA 1992, page 88, line 17, and the reappropriation of the allocation on page 4, lines 28 24 - 25 of the appropriation made in sec. 3, ch. 83, SLA 1993, is less than $109,050, then the 29 grants made in (a) of this section shall be reduced in proportion to the amount of the shortfall. 30 * Sec. 26. The unexpended and unobligated balances of the appropriations made in 31 sec. 154, ch. 5, FSSLA 1992, page 88, line 4 (Thompson Park sewer interceptor construction -

01 $675,000) and sec. 21, ch. 79, SLA 1993, page 78, lines 9 - 10 (Thompson Park water and 02 sewer projects - $750,000) are reappropriated to the Department of Administration for 03 payment as a grant under AS 37.05.315 to the City of Kenai for Kenai water and sewer 04 system improvement projects. 05 * Sec. 27. The unexpended and unobligated balance of the appropriation made in sec. 154, 06 ch. 5, FSSLA 1992, page 91, line 4 (Klatt Elementary School mechanical room safety repairs - 07 $15,000) is reappropriated to the Department of Administration for payment as a grant under 08 AS 37.05.315 to the Municipality of Anchorage, Anchorage School District, Klatt Elementary 09 School, for computer networking and improvements. 10 * Sec. 28. The unexpended and unobligated balance of the appropriation made in sec. 58, 11 ch. 96, SLA 1991, and allocated on page 15, lines 5 - 6 (Huffman Elementary School exhaust 12 fans - $5,000) is reappropriated to the Department of Administration for payment as a grant 13 under AS 37.05.315 to the Municipality of Anchorage, for the Anchorage School District, for 14 Huffman Elementary School site improvement and upgrades to the computer lab and 15 additional playground equipment. 16 * Sec. 29. (a) The unexpended and unobligated balances of the appropriations made by 17 sec. 154, ch. 5, FSSLA 1992, page 101, line 5 (Municipality of Anchorage - Chester Creek 18 and Merrill Field storm trunk - $1,110,000) and sec. 21, ch. 79, SLA 1993, page 97, lines 18 - 19 21 (Municipality of Anchorage - Chester Creek at Merrill Field phase II construction and 20 upgrade - $1,600,000) are repealed and reappropriated for the following purposes and in the 21 following amounts: 22 (1) the sum of $210,000 is appropriated to the Department of Administration 23 for payment as a grant under AS 37.05.315 to the Municipality of Anchorage for design and 24 construction of Far North Hillside Park; 25 (2) the sum of $290,000 is appropriated to the Department of Administration 26 for payment as a grant under AS 37.05.315 to the Municipality of Anchorage for design, 27 construction, rehabilitation, and lighting of the Chester Creek Trail; 28 (3) the sum of $100,000 is appropriated to the Department of Health and Social 29 Services for payment as a grant under AS 37.05.316 to Hope Cottage for debt retirement; 30 (4) the sum of $83,191 is appropriated to the University of Alaska, Anchorage 31 Consortium Library for books and other library materials.

01 (b) If the amount deposited in the general fund by the repeal of the appropriation in 02 (a) of this section is less than $683,191, then the appropriations made by (a) of this section 03 shall be reduced in proportion to the amount of the shortfall. 04 * Sec. 30. The unexpended and unobligated balances of the appropriations made in sec. 05 165, ch. 96, SLA 1991, page 97, line 4 (Sand Lake Elementary School roof repair - $15,000) 06 and sec. 154, ch. 5, FSSLA 1992, page 93, line 5 (Sand Lake Elementary acquisition and 07 upgrade of windows old section - $48,000) are reappropriated to the Department of 08 Administration for payment as a grant under AS 37.05.315 to the Municipality of Anchorage 09 for the Anchorage School District for Sand Lake Elementary School maintenance and site 10 improvement. 11 * Sec. 31. Section 21, ch. 79, SLA 1993, page 58, lines 4 - 7 is amended to read: 12 APPROPRIATION GENERAL 13 ITEMS FUND 14 Salvation Army adult rehabilitation - renovate 15 [CLITHEROE CENTER] facility (ED 10 - 25) 85,000 85,000 16 * Sec. 32. The unexpended and unobligated balance, not to exceed $48,000, of the 17 appropriation made in sec. 165, ch. 96, SLA 1991, page 101, line 5 (Anchorage historic 18 properties 4th Avenue Theater improvements - $100,000) is reappropriated to the Department 19 of Administration for payment as a grant under AS 37.05.315 to the Municipality of 20 Anchorage for the Anchorage Neighborhood Enhancement Youth Employment Project in 21 Election District 15. 22 * Sec. 33. The unexpended and unobligated balance of the appropriation made in sec. 21, 23 ch. 79, SLA 1993, page 85, lines 25 - 27 (Fairview Elementary construct opening in five walls 24 - $50,000) is reappropriated to the Department of Administration for payment as a grant under 25 AS 37.05.315 to the Municipality of Anchorage, Anchorage School District, for planning and 26 design of a new elementary school in Fairview or an addition to the existing Fairview 27 Elementary School. 28 * Sec. 34. The unexpended and unobligated balances of the appropriations made in sec. 58, 29 ch. 96, SLA 1991, page 14, line 30, and allocated on page 15, lines 7 - 8 (Mears Jr. High gym 30 floor crack repair - $5,000); sec. 165, ch. 96, SLA 1991, page 96, line 13 (Mears Jr. High 31 purchase and construction of fence - $30,000); and sec. 165, ch. 96, SLA 1991, page 95, line

01 7 (Mears Jr. High seal windows, exterior - $50,000) are reappropriated to the Department of 02 Administration for payment as a grant under AS 37.05.315 to the Municipality of Anchorage, 03 Anchorage School District, for Mears Jr. High School maintenance and site improvements to 04 physical education areas including gym curtains, blinds, weight room, soccer field, and other 05 site improvements. 06 * Sec. 35. The unexpended and unobligated balance of the appropriation made in sec. 154, 07 ch. 5, FSSLA 1992, page 90, line 18 (Bear Valley School mechanical room safety repairs - 08 $15,000) is reappropriated to the Department of Administration for payment as a grant under 09 AS 37.05.315 to the Municipality of Anchorage, Anchorage School District, for Bear Valley 10 Elementary School networking infrastructure and computers. 11 * Sec. 36. The unexpended and unobligated balances of the appropriations made in 12 sec. 165, ch. 96, SLA 1991, page 95, line 6 (Lake Otis School carpeting - $50,000) and sec. 13 21, ch. 79, SLA 1993, page 90, lines 7 - 9 (Lake Otis Elementary replace exterior windows - 14 $30,000) are reappropriated to the Department of Administration for payment as a grant under 15 AS 37.05.315 to the Municipality of Anchorage, for the Anchorage School District, for 16 maintenance, site improvements, equipment, and computers at Lake Otis Elementary School. 17 * Sec. 37. The unexpended and unobligated balance of the appropriation made in sec. 165, 18 ch. 96, SLA 1991, page 105, line 17 (Baxter School soundproof music room - $20,000) is 19 reappropriated to the Department of Administration for payment as a grant under 20 AS 37.05.315 to the Municipality of Anchorage, Anchorage School District, for Baxter School 21 maintenance and site improvements. 22 * Sec. 38. The unexpended and unobligated balance of the appropriation made in sec. 21, 23 ch. 79, SLA 1993, page 85, lines 35 - 37 (Williwaw Elementary classroom warm water 24 phase I - $27,000) is reappropriated to the Department of Administration for payment as a 25 grant under AS 37.05.315 to the Municipality of Anchorage, Anchorage School District, for 26 Scenic Park Elementary playground equipment. 27 * Sec. 39. The unexpended and unobligated balance of the appropriation made in sec. 21, 28 ch. 79, SLA 1993, page 91, lines 11 - 13 (Airport Heights Elementary carpet upgrade - 29 $20,000) is reappropriated to the Department of Administration for payment as a grant under 30 AS 37.05.315 to the Municipality of Anchorage, Anchorage School District, for Airport 31 Heights Elementary maintenance and site improvements.

01 and Public Facilities for the construction of a road from Cordova to Shepard Point, the 02 construction of oil spill response equipment storage facilities at Shepard Point, and the 03 acquisition of oil spill response equipment for prepositioning at Shepard Point from the 04 following sources in the amounts indicated: 05 (1) the unappropriated and unobligated balance of the interest and income 06 earned through the end of the fiscal year that ends June 30, 1995, on money in the Alyeska 07 Settlement Fund, is appropriated for the purposes of this subsection; 08 (2) the unappropriated and unobligated balance of the interest and income 09 earned during the fiscal year ending June 30, 1995, on the Exxon Valdez oil spill restoration 10 fund, described in sec. 1(1), ch. 79, SLA 1993, is appropriated for the purposes of this 11 subsection; 12 (3) if the amount appropriated by (1) and (2) of this subsection is less than 13 $2,500,000, the difference between the amount appropriated by (1) and (2) of this subsection 14 and $2,500,000 is appropriated from the unappropriated and unobligated balance of the 15 interest and income earned during the fiscal year that ends June 30, 1996, on money in the 16 Alyeska Settlement Fund, for the purposes of this subsection; 17 (4) if the amount appropriated by (1), (2), and (3) of this subsection is less 18 than $2,500,000, the difference between the amount appropriated by (1), (2), and (3) of this 19 subsection and $2,500,000 is appropriated from the unappropriated and unobligated balance 20 of the interest and income earned during the fiscal year ending June 30, 1996, on the Exxon 21 Valdez oil spill restoration fund, described in sec. 1(1), ch. 79, SLA 1993, for the purposes 22 of this subsection. 23 (b) In this section, "Alyeska Settlement Fund" means the trust fund established in the 24 state treasury for the purpose of receiving, holding, and disbursing the settlement proceeds 25 received by the state under the Agreement and Consent Decree in IN RE: The EXXON 26 VALDEZ, United States District Court, District of Alaska, case No. A89-095 Civil 27 (Consolidated)(Re: case No. A92-175 Civil, decree entered November 25, 1992). 28 * Sec. 92. The unexpended and unobligated balance remaining on June 30, 1995, not to 29 exceed $1,000,000, of the appropriation made in sec. 42, ch. 3, FSSLA 1994, page 48, line 30 6 (Budget and Audit Committee - $5,669,400) is reappropriated to the Department of 31 Transportation and Public facilities for nonroutine and deferred maintenance.

01 * Sec. 93. (a) Contingent on the Municipality of Anchorage repaying the sum of $558,972 02 that the state advanced to the municipality and then recalled due to lack of required private 03 investment commitments, the sum of $541,028 of the unexpended and unobligated balance of 04 the appropriation made in sec. 165, ch. 96, SLA 1991, page 108, line 8, through page 109, 05 line 6, as amended by sec. 60, ch. 41, SLA 1993 (Ship Creek redevelopment - $5,500,000) 06 is reappropriated to the Department of Administration for payment as a grant under 07 AS 37.05.315 to the Municipality of Anchorage for utility and road expenses incurred by the 08 Municipality of Anchorage for the Ship Creek redevelopment project. 09 (b) The appropriation made in sec. 165, ch. 96, SLA 1991, page 108, line 8 through 10 page 109, line 6, as amended by sec. 60, ch. 41, SLA 1993, and as amended by (a) of this 11 section, is amended to read: 12 APPROPRIATION GENERAL 13 ITEMS FUND 14  Municipality of Anchorage - Ship Creek 15  Redevelopment (ED 7 - 15) 5,500,000 5,500,000 16  The sum of $5,500,000 is appropriated to the Municipality of Anchorage for 17 access, tidelands fill and utility upgrades for the Ship Creek Basin redevelopment 18 project, contingent upon a development agreement being approved by both the 19 Anchorage Economic Development Corporation and the Alaska Railroad Corporation 20 that includes private investment commitments equal to or exceeding this appropriation. 21  It is the intent of the legislature that this appropriation be available for 22 reappropriation if the required private investment commitments have not been obtained 23 by April 30, 1995. 24  It is also the intent of the legislature that minority-owned and women-owned 25 businesses be encouraged to participate in and be employed in the Ship Creek Basin 26 project to the greatest extent feasible. 27  The appropriation to the Municipality of Anchorage for the Ship Creek 28 Basin redevelopment is further conditioned on the developer and the Municipality 29 of Anchorage satisfying the requirements set out in Section 3.C of Anchorage 30 Ordinance No. 93-183, as amended, approved by the Anchorage Assembly on 31 January 11, 1994, that the developer provide financial commitments in the form

01 of cash performance bonds or deeds of trust in the amount of at least $1,000,000, 02 to be forfeited to the municipality if the structure is not completed in a timely 03 fashion, to assure the developer acts in good faith to build the tourist attraction. 04 The appropriation is further contingent on the developer demonstrating to the 05 satisfaction of the Department of Administration that the developer has, no later 06 than March 1, 1996, satisfied the requirement for obtaining private investment 07 commitments equal to or exceeding $5,500,000 and for obtaining cash 08 performance bonds or deeds of trust in the amount of at least $1,000,000 payable 09 to the municipality; funds expended or bonds issued by the Alaska Railroad 10 Corporation may not be considered in determining whether the developer has 11 satisfied these requirements. 12 * Sec. 94. The unexpended and unobligated balance of the appropriation made in sec. 3, 13 ch. 128, SLA 1986, page 21, line 8, and allocated on line 16 (high speed ferry system phase 14 I - $4,905,000) is reappropriated to the Alaska Science and Technology Foundation for grants 15 for the fiscal year ending June 30, 1996. 16 * Sec. 95. If the appropriation made by this 21 subsection is not approved by at least three-fourths vote of each house of the legislature, then 22 the appropriation is made under art. IX, sec. 17(b), Constitution of the State of Alaska and the 23 amount appropriated under this subsection is limited to the amount permitted under art. IX, 24 sec. 17(b). 25 * Sec. 127.
