01 "An Act prohibiting certain amplified sounds from automobiles; and providing for                                        
02 an effective date."                                                                                                     
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 28.35 is amended by adding a new section to read:                                                   
05  Sec. 28.35.185.  PROHIBITED SOUND SYSTEMS.  (a)  A person may not                                                     
06 operate or permit operation of a sound amplification system in a motor vehicle when                                     
07 the motor vehicle is operated on or is parked next to a highway, vehicular way, or                                      
08 other public area if the sound amplification system is audible from a distance of 50 or                                 
09 more feet.  This subsection does not apply to                                                                           
10   (1)  a person operating a sound amplification system to request                                                      
11 emergency assistance or to warn of a hazardous condition;                                                               
12   (2)  an emergency or police motor vehicle; or                                                                        
13   (3)  a motor vehicle engaged in advertising otherwise permitted by law.                                              
14  (b)  A person who violates this section is guilty of an infraction and may be                                         

01 punished as provided under AS 28.40.050(c) and (d).                                                                     
02    * Sec. 2.  This Act takes effect July 1, 1996.
