01 "An Act authorizing the commissioner of fish and game to issue permits to                                               
02 possess, import, or export elephants; and providing for an effective date."                                             
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 16.40 is amended by adding a new section to article 1 to read:                                      
05  Sec. 16.40.060.  ELEPHANT PERMIT.  The commissioner may issue a permit,                                               
06 subject to reasonable conditions established by the commissioner, to possess, import, or                                
07 export an elephant.  A permit may be issued only to a person who proves to the                                          
08 satisfaction of the commissioner that the person                                                                        
09   (1)  intends to exhibit the animal commercially;                                                                     
10   (2)  possesses facilities to maintain the animal under positive control and                                          
11 humane conditions; and                                                                                                  
12   (3)  maintains personal injury and property damage insurance in an                                                   
13 amount established by the commissioner.                                                                                 
14    * Sec. 2.  This Act takes effect immediately under AS 01.10.070(c).
