00HOUSE BILL NO. 206 01 "An Act relating to the revocation of a minor's license to drive, privilege to 02 drive, or privilege to obtain a driver's license for an offense involving a 03 controlled substance, possession or consumption of alcohol, or the illegal use or 04 possession of a firearm; and requiring the expulsion or suspension of students 05 possessing deadly weapons." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 14.03 is amended by adding a new section to read: 08  Sec. 14.03.160. SUSPENSION OR EXPULSION OF STUDENTS FOR 09 POSSESSING WEAPONS. (a) Notwithstanding any other provision of law, a school 10 district shall 11  (1) expel for at least one year a student who violates 12 AS 11.61.220(a)(4) while possessing a firearm, as that term is defined under 18 U.S.C. 13 921; 14  (2) suspend for at least 30 days or expel for the school year or

01 permanently, a student who violates AS 11.61.220(a)(4) while possessing a deadly 02 weapon, other than a firearm as that term is defined under 18 U.S.C. 821. 03  (b) The administrative officer of a school district may on a case-by-case basis 04 reduce or otherwise modify the expulsion or suspension of a student under (a) of this 05 section. 06  (c) A prior conviction, or adjudication of delinquency or child in need of aid, 07 for violation of AS 11.61.220(a)(4) is not necessary for a school board to suspend or 08 expel a student under this section. 09  (d) Each school district shall adopt a policy providing for the referral to law 10 enforcement authorities of students who violate AS 11.61.220(a)(4). 11  (e) Annually on a date set by the department, each school district shall report 12 to the department the number of students expelled under this section and the types of 13 weapons involved. 14  (f) In this section, 15  (1) "deadly weapon" has the meaning given in AS 11.81.900; 16  (2) "district" has the meaning given in AS 14.17.250. 17 * Sec. 2. AS 28.15.185(a) is amended to read: 18  (a) a person who is at least 13 years of age but not older than 17 years of age 19 who is convicted of or adjudicated by a juvenile court of misconduct involving a 20 controlled substance under AS 11.71 or possession or consumption of alcohol under 21 AS 04.16.050 or any offense under AS 11 involving the illegal use or possession 22 of a firearm is subject to revocation of the person's driver's license, privilege to 23 drive, or privilege to obtain a driver's license under (b) of this section. 24 * Sec. 3. The provisions regarding illegal use or possession of a firearm enacted by secs. 1 25 and 2 of this Act apply to an act committed on or after the effective date of this Act.
