00HOUSE BILL NO. 178 01 "An Act making supplemental and special appropriations for the expenses of state 02 government; making and amending capital and operating appropriations; and 03 providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. The sum of $212,200 is appropriated from the general fund to the Office of 06 the Governor, division of elections, for unanticipated costs relating to the 1994 elections for 07 the fiscal year ending June 30, 1995. 08 * Sec. 2. The sum of $36,700 is appropriated from the general fund to the Department of 09 Administration for operating costs for the Rural Alaska Television Network for the fiscal year 10 ending June 30, 1995. 11 * Sec. 3. The sum of $530,000 is appropriated from the general fund to the Department 12 of Administration, office of public advocacy, for increased operating costs for the fiscal year 13 ending June 30, 1995. 14 * Sec. 4. The sum of $125,000 is appropriated from the general fund to the Department

01 of Administration, public defender agency, for increased operating costs for the fiscal year 02 ending June 30, 1995. 03 * Sec. 5. The sum of $37,500 is appropriated from the general fund to the Department of 04 Administration, retirement and benefits program, for increased costs to the Elected Public 05 Officers Retirement System for the fiscal year ending June 30, 1995. 06 * Sec. 6. The sum of $93,000 is appropriated from the general fund to the Department of 07 Administration for additional lease costs in the leasing program for the fiscal year ending 08 June 30, 1995. 09 * Sec. 7. The sum of $49,500 is appropriated from the general fund to the Department of 10 Administration, Alaska Public Offices Commission, for hearing costs relating to State of 11 Alaska v. Gravo, for the fiscal year ending June 30, 1995. 12 * Sec. 8. The sum of $139,600 is appropriated from the general fund to the Department 13 of Administration, division of personnel, for additional labor arbitration costs for the fiscal 14 year ending June 30, 1995. 15 * Sec. 9. The sum of $1,854,820 is appropriated from the general fund to the Department 16 of Law to pay judgments and claims against the state related to Weiss v. State for the fiscal 17 year ending June 30, 1995, from the following sources: 18 General fund/mental health $1,554,820 19 General fund 300,000 20 * Sec. 10. The sum of $500,000 is appropriated from the general fund to the Department 21 of Law to pay federal judgments and claims against the state related to inappropriate cost 22 allocation charges for the fiscal year ending June 30, 1995. 23 * Sec. 11. The sum of $494,838 is appropriated from the general fund to the Department 24 of Law to pay judgments and claims against the state for the fiscal year ending June 30, 1995. 25 * Sec. 12. The sum of $50,000 is appropriated from the general fund to the Department 26 of Law for attorney fees related to the lawsuit challenging the 1994 gubernatorial election for 27 the fiscal year ending June 30, 1995. 28 * Sec. 13. The sum of $33,800 is appropriated from general fund program receipts to the 29 Department of Revenue, division of charitable gaming, for costs associated with the Charitable 30 Gaming Task Force appointed by the governor on January 25, 1995, for the fiscal year ending 31 June 30, 1995.

The sum of $15,000 is appropriated from general fund program receipts to the 02 Department of Revenue, Alcoholic Beverage Control Board, for costs associated with a license 03 denial appeal in Egegik for the fiscal year ending June 30, 1995. 04 * Sec. 15. The sum of $259,500 is appropriated from the general fund to the Department 05 of Revenue, treasury division, to pay for additional safekeeping and debt management fees for 06 the fiscal year ending June 30, 1995. 07 * Sec. 16. The sum of $91,100 is appropriated from the permanent fund dividend fund 08 (AS 43.23.045) to the Department of Revenue, permanent fund dividend division, to cover 09 additional data processing costs for the fiscal year ending June 30, 1995. 10 * Sec. 17. The sum of $283,100 is appropriated from the mental health trust settlement 11 income account (AS 37.14.036) to the Department of Revenue to pay costs related to the 12 creation of the Alaska Mental Health Trust Authority (AS 47.30.011) for the fiscal year ending 13 June 30, 1995. 14 * Sec. 18. The sum of $2,000,000 is appropriated from the general fund to the Department 15 of Education for the public school foundation program (AS 14.17) for increased student 16 enrollment for the fiscal year ending June 30, 1995. 17 * Sec. 19. The sum of $615,700 is appropriated from the general fund to the Department 18 of Education for vocational educational grant reimbursement to the federal government for 19 fiscal years 1990 and 1991. 20 * Sec. 20. The sum of $22,169 is appropriated from the general fund to the Department 21 of Education, Alaska Commission on Postsecondary Education, for WAMI contractual costs 22 for the fiscal year ending June 30, 1995. 23 * Sec. 21. The sum of $2,197,000 is appropriated from the general fund to the Department 24 of Education for Toksook Bay school district fuel spill settlement and cleanup costs for the 25 fiscal year ending June 30, 1995. 26 * Sec. 22. The sum of $871,700 is appropriated from general fund program receipts to the 27 Department of Health and Social Services, division of medical assistance, for increased levels 28 of pharmaceutical rebates for the fiscal year ending June 30, 1995. 29 * Sec. 23. The sum of $4,000,000 is appropriated from federal receipts to the Department 30 of Health and Social Services for increased Indian Health Service Medicaid claims for the 31 fiscal year ending June 30, 1995.

The sum of $966,000 is appropriated to the Department of Health and Social 02 Services, division of medical assistance, for restoration of seven optional Medicaid services 03 for the fiscal year ending June 30, 1995 from the following sources: 04 Federal receipts $ 483,000 05 General fund receipts 483,000 06 * Sec. 25. The sum of $392,900 is appropriated to the Department of Health and Social 07 Services, division of family and youth services, to restore and maintain child protection 08 services for the fiscal year ending June 30, 1995 from the following sources: 09 Federal receipts  $310,600 10 General fund receipts 82,300 11 * Sec. 26. The sum of $580,500 is appropriated from the general fund to the Department 12 of Health and Social Services, division of family and youth services, McLaughlin Youth 13 Center, to maintain adequate staffing for exceptionally high client load for the fiscal year 14 ending June 30, 1995. 15 * Sec. 27. The sum of $342,000 is appropriated from the general fund to the Department 16 of Health and Social Services, division of public health, to control the tuberculosis outbreak 17 and to conduct epidemiological investigations for the fiscal year ending June 30, 1995. 18 * Sec. 28. The sum of $900,000 is appropriated from the general fund to the disaster relief 21 fund (AS 26.23.300) for costs associated with declared disasters, for the fiscal year ending 22 June 30, 1995. 23 * Sec. 33. The sum of $1,660,000 is appropriated from the general fund to the Department 24 of Natural Resources for fire suppression activities for the fiscal year ending June 30, 1994. 25 * Sec. 34. The sum of $7,195,000 is appropriated from the general fund to the Department 26 of Natural Resources for fire suppression activities for the fiscal year ending June 30, 1995. 27 * Sec. 35. The appropriations made in compliance with the program review procedures of 28 AS 37.07.080(h) to implement Trustee Council restoration projects for federal fiscal year 29 1995, set out in revised programs 11-5-9990 and 11-5-9991, lapse into the funds from which 30 they were appropriated June 30, 1996. 31 * Sec. 36. The sum of $682,400 is appropriated from the general fund to the Department

01 of Public Safety for increased operating costs for the community jails, to conform with 02 operating standards recommended in the December 1994 Governor's Task Force on the 03 Community Jails Program Final Report, for the fiscal year ending June 30, 1995. 04 * Sec. 37. The sum of $200,000 is appropriated from the general fund to the Department 05 of Public Safety, division of Alaska state troopers, for arbitration costs for the fiscal year 06 ending June 30, 1995. 07 * Sec. 38. The sum of $156,000 is appropriated from the general fund to the Department 08 of Public Safety, civil air patrol, to support search and rescue operations for the fiscal year 09 ending June 30, 1995. 10 * Sec. 39. The funding sources for the detachments component of the appropriation for 11 House Bill No. 351 (permit to carry concealed weapons/DPS) in sec. 43, ch. 3, FSSLA 1994, 12 page 50, lines 19 - 21, are amended as follows to reflect a shortfall in program receipts for 13 the fiscal year ending June 30, 1995: 14 General Fund Receipts 186,500 15 General Fund/Program Receipts 489,800 [676,300] 16 * Sec. 40. The funding sources for the Department of Public Safety, Narcotics Task Force, 17 allocation in sec. 42, ch. 3, FSSLA 1994, page 33, line 30, are amended as follows to reflect 18 uncollectible program receipts from seized assets for the fiscal year ending June 30, 1995: 19 General Fund Receipts 264,100 [149,100] 20 General Fund/Program Receipts 476,000 [591,000] 21 * Sec. 41. The sum of $2,340,000 is appropriated from the general fund to the Department 22 of Transportation and Public Facilities, statewide highways and aviation maintenance and 23 operations, for operations necessitated by extraordinary snowfall for the fiscal year ending 24 June 30, 1995. 25 * Sec. 42. The sum of $60,000 is appropriated from the general fund to the Department 26 of Transportation and Public Facilities, statewide facilities maintenance and operations, for 27 operations necessitated by extraordinary snowfall for the fiscal year ending June 30, 1995. 28 * Sec. 43. The sum of $250,000 is appropriated from the International Airports Revenue 29 Fund to the Department of Transportation and Public Facilities, Anchorage International 30 Airport, for operations necessitated by extraordinary snowfall for the fiscal year ending 31 June 30, 1995.

The sum of $25,000 is appropriated from the general fund to the Department 02 of Transportation and Public Facilities, statewide highways and aviation maintenance and 03 operations, for erosion repairs at the Nanwalek (English Bay) airport for the fiscal year ending 04 June 30, 1995. 05 * Sec. 45. The sum of $340,000 is appropriated from the general fund to the Department 06 of Transportation and Public Facilities, statewide highways and aviation maintenance and 07 operations, for a temporary bridge across Nutirwik Creek for the fiscal year ending June 30, 08 1995. 09 * Sec. 46. The sum of $100,000 is appropriated from the general fund to the Department 10 of Transportation and Public Facilities, statewide highways and aviation maintenance and 11 operations, for culvert replacements under the Birchwood Loop Road and Rabbit Creek Road 12 for the fiscal year ending June 30, 1995. 13 * Sec. 47. The sum of $30,000 is appropriated from the general fund to the Department 14 of Transportation and Public Facilities, statewide highways and aviation maintenance and 15 operations, for personnel and equipment costs for responding to the Haines Highway 16 mudslides for the fiscal year ending June 30, 1995. 17 * Sec. 48. The sum of $750,000 is appropriated from the general fund to the Department 18 of Transportation and Public Facilities, statewide highways and aviation maintenance and 19 operations, for the spring maintenance program for the fiscal year ending June 30, 1995. 20 * Sec. 49. The sum of $230,308 is appropriated from the general fund to the Department 21 of Transportation and Public Facilities, statewide highways and aviation maintenance and 22 operations, for legal bills related to the Copper River Highway litigation for the fiscal year 23 ending June 30, 1995. 24 * Sec. 50. The sum of $89,664 is appropriated from the general fund to the Department 25 of Transportation and Public Facilities, statewide highways and aviation maintenance and 26 operations, for legal bills related to Native allotment issues for the fiscal year ending June 30, 27 1995. 28 * Sec. 51. The sum of $145,000 is appropriated from the International Airports Revenue 29 Fund to the Department of Transportation and Public Facilities, Anchorage International 30 Airport, to pay the court-ordered personnel costs of two employees for the fiscal year ending 31 June 30, 1995.

The sum of $739,836, attributable to interest earned on money in the Alaska 02 Marine Highway System Fund (AS 19.65.060), is appropriated from the general fund to the 03 Alaska Marine Highway System Fund (AS 19.65.060). 04 * Sec. 53. The unexpended and unobligated balance of that portion of the appropriation 05 made to the Department of Community and Regional Affairs in sec. 42, ch. 3, FSSLA 1994, 06 page 40, line 19, that is allocated in sec. 42, ch. 3, FSSLA 1994, page 40, line 27, (Rural 07 Development Grants - $1,518,100) lapses into the general fund June 30, 1996. 08 * Sec. 54. The sum of $50,000 is appropriated from the general fund to the Department 09 of Community and Regional Affairs for the City of Egegik for a first-year organizational grant 10 as required by AS 29.05.180. 11 * Sec. 55. The funding sources for the Department of Corrections, Cook Inlet Correctional 12 Center, allocation in sec. 42, ch. 3, FSSLA 1994, page 42, line 24, are amended as follows, 13 to reflect uncollectible program receipts from prisoner telephone calls for the fiscal year 14 ending June 30, 1995: 15 General Fund Receipts 7,685,200 [7,485,200] 16 General Fund/Program Receipts 48,200 [248,200] 17 * Sec. 56. The sum of $39,300 is appropriated from the general fund to the Department 18 of Corrections to facilitate transfer of the community jails program from the Department of 19 Public Safety to the Department of Corrections for the fiscal year ending June 30, 1995. 20 * Sec. 57. The sum of $1,611,500 is appropriated from the general fund to the Department 21 of Corrections to pay contempt of court fines for the fiscal year ending June 30, 1995. 22 * Sec. 58. The sum of $457,000 is appropriated from the general fund to the Department 23 of Corrections, office of the commissioner, for resolution of legal personnel actions for the 24 fiscal year ending June 30, 1995. 25 * Sec. 59. The sum of $130,100 is appropriated from the general fund to the University 26 of Alaska, Anchorage and Prince William Sound campuses, for unanticipated snow and ice 27 removal costs for the fiscal year ending June 30, 1995. 28 * Sec. 60. The sum of $106,900 is appropriated from the general fund to the Alaska Court 29 System, trial courts, for costs associated with the Arctic North Slope royalty case for the fiscal 30 year ending June 30, 1995. 31 * Sec. 61. The sum of $51,700 is appropriated from the general fund to the Alaska Court

The sum of $1,800,000 is appropriated from corporate receipts to the 20 Department of Revenue, Alaska Housing Finance Corporation, for the supplemental housing 21 program. 22 * Sec. 65. The sum of $41,625 is appropriated from the general fund to the Department 23 of Public Safety for payment to the Alaska Wing of the Civil Air Patrol for replacement of 24 the roof of the civil air patrol hanger at Merrill Field. 25 * Sec. 66. The sum of $100,000 is appropriated from the general fund to the Department 26 of Public Safety for payment to the City of Homer for upgrades to the Homer jail facility to 27 meet fire and building codes. 28 * Sec. 67. The sum of $45,000 is appropriated from the general fund to the Department 29 of Public Safety for payment to the North Slope Borough for improved emergency access at 30 the North Slope Borough jail facility. 31 * Sec. 68. The sum of $153,000 is appropriated from the general fund to the University

01 of Alaska, statewide programs and services, for Butrovich Building panel removals. 02 * Sec. 69. The sum of $2,326,000 is appropriated to the University of Alaska, statewide 03 programs and services, for Butrovich Building panel replacement from the following sources: 04 General fund receipts $ 1,326,000 05 University receipts 1,000,000 06 * Sec. 70. The appropriation made by sec. 54 of this Act is not a one-year appropriation 07 and is not subject to AS 37.25.010. 08 * Sec. 71. The appropriations made by secs. 63 - 69 of this Act are for capital projects and 09 are subject to AS 37.25.020. 10 * Sec. 72. (a) Section 57 of this Act takes effect only if the attorney general notifies the 11 office of management and budget in the Office of the Governor, and the revisor of statutes, 12 that there is no pending issue and no court order in Cleary, et al. v. Smith, et al. (3AN-81- 13 5274 Civ) that would prevent the court system from depositing the Department of Corrections 14 contempt of court fines in the general fund. 15 (b) If sec. 57 of this Act takes effect, it takes effect on the date of the attorney 16 general's notification under (a) of this section. 17 * Sec. 73. Except as provided in sec. 72 of this Act, this Act takes effect immediately 18 under AS 01.10.070(c).
