01 "An Act defining the scope of the responsibility of the Department of Natural                                           
02 Resources for regulating the mineral resources of the state."                                                           
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS  27.05.010 is amended by adding a new subsection to read:                                           
05  (b)  The department is the lead agency for all matters relating to the                                                
06 exploration, development, and management of mining, and, notwithstanding any other                                      
07 provision of state law, shall make the final determination on all regulatory matters                                    
08 concerning mineral resource exploration and development and the management of                                           
09 mining and associated activities.  Another state agency may advise or consult with the                                  
10 department in making its determination.
