00SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 110 01 "An Act relating to the confidentiality of certain information in motor vehicle 02 records; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 28.05.061 is amended by adding a new subsection to read: 05 (d) The address and telephone number of a person identified in a registration 06 record, title, or document maintained by the department under AS 28.10 is not subject 07 to inspection or disclosure as a public record and may not be released unless the 08 person requesting the information has a legitimate interest in the information as defined 09 by the department by regulation. 10 * Sec. 2. AS 28.05.061(d) is repealed and reenacted to read: 11 (d) Personal information identified in a registration record, title, or document 12 maintained by the department under AS 28.10 is subject to inspection and disclosure 13 as a public record only as provided under 18 U.S.C. 2721. 14 * Sec. 3. REGULATIONS. The department may proceed to adopt regulations under
01 AS 28.05.061(d), enacted by sec. 1 of this Act. The regulations take effect under AS 44.62 02 (Administrative Procedure Act), but not before the effective date of sec. 1 of this Act. 03 * Sec. 4. Section 2 of this Act takes effect September 13, 1997. 04 * Sec. 5. Section 3 of this Act takes effect immediately under AS 01.10.070(c).
