00SENATE BILL NO. 273 01 "An Act changing from February 15 to January 15 the date for filing year-end 02 campaign finance reports for persons and groups who are required to file reports 03 of activity in municipal elections with the Alaska Public Offices Commission." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 15.13.010(a) is amended to read: 06  (a) This chapter applies 07  (1) in every election for governor, lieutenant governor, a member of the 08 state legislature, a delegate to a constitutional convention, or judge seeking electoral 09 confirmation; 10  (2) [. IT ALSO APPLIES] to every candidate for election to a 11 municipal office in a municipality with a population of more than 1,000 inhabitants 12 according to the latest United States census figures or estimates of population certified 13 as correct for administrative purposes by the Department of Community and Regional 14 Affairs; however,

01  (A) a [. A] municipality may exempt its elected municipal 02 officers from the requirements of this chapter if a majority of the voters voting 03 on the question at a regular election, as defined by AS 29.71.800(20), or a 04 special municipality-wide election called for that purpose, vote to exempt its 05 elected municipal officers from the requirements of this chapter; the [. THE] 06 question of exemption from the requirements of this chapter may be submitted 07 by the governing body by ordinance or by initiative election; and 08  (B) this [. THIS] chapter does not prohibit a municipality from 09 regulating by ordinance campaign contributions and expenditures. 10 * Sec. 2. AS 15.13.110(a) is amended to read: 11  (a) Each candidate and group shall make a full report in accordance with 12 AS 15.13.040 for the period ending three days before the due date of the report and 13 beginning on the last day covered by the most recent previous report. If the report is 14 a first report, it shall cover the period from the beginning of the campaign to the date 15 three days before the due date of the report. If the report is a report due under (4) of 16 this subsection [FEBRUARY 15], it shall cover the period beginning on the last day 17 covered by the most recent previous report or on the day that the campaign started, 18 whichever is later, and ending on December 31 of the prior year. The report shall be 19 filed 20  (1) 30 days before the election; however, this report is not required if 21 the deadline for filing a nominating petition or declaration of candidacy is within 30 22 days of the election; 23  (2) one week before the election; 24  (3) 10 days after the election; and 25  (4) on the appropriate date specified in this paragraph 26 [FEBRUARY 15] for expenditures made and contributions received that were not 27 reported during the previous year or when expenditures were not made or contributions 28 were not received during the previous year: 29  (A) February 15 30  (i) for persons required to file under 31 AS 15.13.010(a)(1); and

01  (ii) for persons and groups required to file under 02 AS 15.13.010(b) for contributions, expenditures, and 03 communications made for the purpose of influencing a ballot 04 proposition or question on a state primary, general, or special 05 election ballot, or to influence the nomination or election of a 06 candidate for an office described in AS 15.13.010(a)(1); and 07  (B) January 15 08  (i) for persons required to file under 09 AS 15.13.010(a)(2); and 10  (ii) for persons and groups required to file under 11 AS 15.13.010(b) for contributions, expenditures, and 12 communications made for the purpose of influencing a ballot 13 proposition or question on a municipal general, runoff, or special 14 election ballot, or to influence the nomination or election of a 15 candidate for a municipal office under AS 15.13.010(a)(2).
