00CS FOR SENATE BILL NO. 181(HES) 01 "An Act relating to grants for school construction; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.11.013(b) is repealed and reenacted to read: 05  (b) The department shall recommend school construction grants in the order 06 of priority established by the grant review committee under AS 14.11.014. 07 * Sec. 2. AS 14.11.013(d) is amended to read: 08  (d) The department shall reduce a project budget by the cost of those portions 09 of a project design that the department determines (1) are for construction of student 10 residential space, planetariums, hockey rinks, saunas, and other facilities for single 11 purpose sporting or recreational uses that are not suitable for other activities; and (2) 12 do not meet the design criteria specified under (f) of this section that are 13 applicable to the project. This subsection does not apply to funding for swimming 14 pools that meet criteria established by the department.

01 * Sec. 3. AS 14.11.013(e) is amended to read: 02  (e) By November 5, the department shall provide public notice of the grant 03 applications submitted under (a) of this section and the priorities established under 04 AS 14.11.014 [(b) OF THIS SECTION]. After public notice has been given, the 05 department shall, not later than December 1, hold a public hearing on the priorities 06 established under AS 14.11.014 [(b) OF THIS SECTION]. In this subsection, "public 07 notice" means notice published in a newspaper of general circulation and notice to 08 every person who has requested notice about the grant application program from the 09 department. 10 * Sec. 4. AS 14.11.013 is amended by adding a new subsection to read: 11  (f) The department shall, in consultation with the Department of Transportation 12 and Public Facilities, develop standard regional design specifications for the 13 construction of schools in the state. Standard regional school design specifications 14 shall be developed for the arctic, interior, western, and southeastern regions of the 15 state. For each school construction project for which a grant is requested under 16 AS 14.11.011, the department shall determine which standard regional school design 17 specifications are applicable to that project. 18 * Sec. 5. AS 14.11 is amended by adding a new section to read: 19  Sec. 14.11.014. GRANT REVIEW COMMITTEE. (a) The commissioner 20 shall establish a grant review committee for the purpose of establishing the 21 department's priorities among projects for which school construction grants are 22 requested and for the purpose of preparing a construction grant schedule. The 23 committee shall consist of the commissioner or the commissioner's designee and five 24 other people selected by the commissioner who have the following qualifications: 25  (1) one person shall be licensed under AS 08.48 as an engineer; 26  (2) one person shall have a teaching certificate issued by the 27 department; 28  (3) one person shall be licensed as a construction contractor under 29 AS 08.18; 30  (4) one person shall be licensed under AS 08.48 as an architect; and 31  (5) one person shall have five years of experience in facilities

01 management. 02  (b) In establishing priorities among grants as required under this section, the 03 grant review committee shall evaluate all of the following factors: 04  (1) emergency requirements; 05  (2) priorities assigned by the district to the projects requested; 06  (3) new local elementary and secondary programs; 07  (4) existing regional, community, and school facilities, and their 08 condition; and 09  (5) alternative education program options for accomplishing the 10 project's objectives. 11  (c) Members of the committee serve without compensation, but members who 12 are not representing the department or the Department of Transportation and Public 13 Facilities are entitled to per diem and travel expenses authorized for boards and 14 commissions under AS 39.20.180. 15 * Sec. 6. This Act takes effect July 1, 1993.
