00SENATE BILL NO. 144 01 "An Act dividing the Department of Transportation and Public Facilities into two 02 principal departments; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. LEGISLATIVE FINDINGS AND PURPOSE. The legislature finds that the 05 diverse needs of the state with respect to public facilities and land, air, and marine 06 transportation would be best served by the creation of two distinct departments. One 07 department should plan, construct, manage, operate, and maintain the air and land 08 transportation systems of the state. Another department should perform those functions with 09 respect to marine transportation, state ferries, harbors, docks, floats, breakwaters, buildings, 10 and similar public works. 11 * Sec. 2. AS 44.17.005 is amended to read: 12  Sec. 44.17.005. OFFICES AND DEPARTMENTS. There are in the state 13 government the following principal offices and departments: 14  (1) Office of the Governor;

01  (2) Department of Administration; 02  (3) Department of Law; 03  (4) Department of Revenue; 04  (5) Department of Education; 05  (6) Department of Health and Social Services; 06  (7) Department of Labor; 07  (8) Department of Commerce and Economic Development; 08  (9) Department of Military and Veterans' Affairs; 09  (10) Department of Natural Resources; 10  (11) Department of Fish and Game; 11  (12) Department of Public Safety; 12  (13) [REPEALED 13  (14) REPEALED 14  (15) DEPARTMENT OF TRANSPORTATION AND PUBLIC 15 FACILITIES 16  (16)] Department of Environmental Conservation; 17  (14) [(17)] Department of Community and Regional Affairs; 18  (15) [(18)] Department of Corrections; 19  (16) Department of Air and Land Transportation; 20  (17) Department of Marine Transportation and Public Works. 21 * Sec. 3. DEPARTMENT OF AIR AND LAND TRANSPORTATION. (a) There is 22 created as a principal department of state government the Department of Air and Land 23 Transportation. The principal executive officer of the department is the commissioner of air 24 and land transportation. 25 (b) The Department of Air and Land Transportation shall plan, construct, manage, 26 operate, and maintain all state highways, roads, bridges, traffic signs and signals, airports, 27 landing strips, and other highway and aviation facilities, specifically including the duties 28 formerly held by the Department of Transportation and Public Facilities under 29 (1) AS 02; 30 (2) AS 18.40; 31 (3) AS 19.10 - AS 19.45;

01 (4) AS 35, except with respect to marine facilities and public buildings; and 02 (5) AS 37.15. 03 (c) The Department of Air and Land Transportation shall procure and maintain state 04 equipment used in the performance of its duties under this section. 05 (d) In performing the duties assigned to the department under this section, the 06 Department of Air and Land Transportation 07 (1) is subject to the restrictions placed on the former Department of 08 Transportation and Public Facilities with respect to those duties; and 09 (2) has the powers bestowed on the former Department of Transportation and 10 Public Facilities with respect to those duties. 11 * Sec. 4. DEPARTMENT OF MARINE TRANSPORTATION AND PUBLIC WORKS. 12 (a) There is created as a principal department of state government the Department of Marine 13 Transportation and Public Works. The principal executive officer of the department is the 14 commissioner of marine transportation and public works. 15 (b) The Department of Marine Transportation and Public Works shall plan, construct, 16 manage, operate, and maintain marine transportation facilities, state ferries, water and harbor 17 facilities, park and recreation facilities, and public buildings, specifically including the duties 18 formerly held by the Department of Transportation and Public Facilities under 19 (1) AS 19.60 - AS 19.65; 20 (2) AS 30; 21 (3) AS 35, except with respect to highways and aviation facilities; and 22 (4) AS 41.21. 23 (c) The Department of Marine Transportation and Public Works shall procure and 24 maintain state equipment used in the performance of its duties under this section. 25 (d) In performing the duties assigned to the department under this section, the 26 Department of Marine Transportation and Public Works 27 (1) is subject to the restrictions placed on the former Department of 28 Transportation and Public Facilities with respect to those duties; 29 (2) has the powers bestowed on the former Department of Transportation and 30 Public Facilities with respect to those duties. 31 * Sec. 5. The division of legal services of the Legislative Affairs Agency shall prepare a

01 bill conforming the Alaska Statutes to the changes made by this Act. The bill shall be 02 presented to the House and Senate Rules Committees for introduction on the first day of the 03 Second Session of the Eighteenth Alaska State Legislature. 04 * Sec. 6. Sections 1 - 4 of this Act take effect July 1, 1994. 05 * Sec. 7. Section 5 of this Act takes effect immediately under AS 01.10.070(c).
