00SENATE BILL NO. 78 01 "An Act relating to deadlines for action on funding of public education; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.11.100(c) is amended to read: 05  (c) The school construction account is established. Funds to carry out the 06 provisions of this section shall be included within the general appropriation bill 07 submitted to the legislature under AS 37.07.020 and may be appropriated annually by 08 the legislature to the account. Before March 7, the legislature shall appropriate 09 funds to eligible municipalities under this section for the next fiscal year. If 10 amounts in the account are insufficient for the purpose of providing the share to which 11 a borough or city is entitled under this section, those funds that are available shall be 12 distributed pro rata among the eligible local governments except that the legislature 13 may direct that additional debt service on refunding bonds that exceeds the total debt 14 service on the refunded bonds be disregarded in whole or in part.

01 * Sec. 2. AS 14.14.060(c) is amended to read: 02  (c) The borough school board shall submit the school budget for the following 03 school year to the borough assembly by April 30 [APRIL 1] for approval of the 04 [TOTAL] amount of money funded from local sources. Within 30 days after receipt 05 of the budget the assembly shall determine the total amount of money to be made 06 available from local sources for school purposes and shall furnish the school board 07 with a statement of the sum to be made available. If the assembly does not, within 08 30 days, furnish the school board with a statement of the sum to be made available, 09 the amount requested in the budget is automatically approved. By May 31, the 10 assembly shall appropriate the amount to be made available from local sources from 11 money available for the purpose. 12 * Sec. 3. AS 14.17.225(b) is amended to read: 13  (b) Money to carry out the provisions of AS 14.17.010 - 14.17.190 may be 14 appropriated annually by the legislature into the public school foundation account. 15 Before March 7, the legislature shall appropriate funds for direct and indirect 16 services and other funding under this chapter for the next fiscal year. If amounts 17 in the account are insufficient to meet the allocations authorized under AS 14.17.010 - 18 14.17.190 for a fiscal year, each district's basic need shall be reduced pro rata as 19 necessary to make the funds available sufficient to meet the allocations for that fiscal 20 year. 21 * Sec. 4. AS 37.07.030 is amended to read: 22  Sec. 37.07.030. RESPONSIBILITIES OF THE LEGISLATURE. The legis- 23 lature shall 24  (1) provide for a budget review function; 25  (2) analyze the comprehensive operating and capital improvements 26 programs and financial plans recommended by the governor; 27  (3) adopt legislation to authorize implementation of the governor's 28 comprehensive operating and capital improvements programs and financial plans or 29 appropriate alternatives to those plans; 30  (4) provide for a post-audit function to cover financial transactions, 31 program accomplishment, and compliance with legislative intent;

01  (5) adopt or revise the estimate or receipts required to balance the 02 succeeding fiscal year's budget in order that proposed expenditures do not exceed 03 estimated receipts for that fiscal year; 04  (6) adopt, revise, or initiate revenue measures in order to balance the 05 succeeding fiscal year's budget and the capital improvements section of the budget for 06 the succeeding six years; 07  (7) appropriate money for the succeeding fiscal year for public 08 school construction debt retirement under AS 14.11.100, public school foundation 09 program under AS 14.17, pupil transportation, student lunch program, cigarette 10 tax distribution, tuition students, boarding home grants, youth in detention, and 11 schools for the handicapped no later than March 7 of each year. 12 * Sec. 5. This Act takes effect July 1, 1993.
