00SENATE BILL NO. 75 01 "An Act relating to the reporting of certain steering malfunctions, losses of 02 power, or other situations significantly affecting the seaworthiness of tank vessels; 03 and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 46.03 is amended by adding a new section to read: 06  Sec. 46.03.741. TANK VESSEL REPORTING AND CERTIFICATION 07 REQUIREMENTS. (a) A person in charge of a tank vessel that is within the waters 08 of the state and that is experiencing a steering malfunction, loss of power, or other 09 situation that significantly affects the seaworthiness of the vessel, shall immediately 10 notify the United States Coast Guard and appropriate state authorities of the 11 malfunction, loss, or other situation, if the malfunction, loss, or other situation is not 12 repaired or corrected within 60 minutes of the occurrence of the malfunction, loss, or 13 other situation. The time limit for repair or correction of a malfunction, loss, or other 14 situation before notification is required under this subsection begins at the time of the

01 occurrence of the malfunction, loss, or other situation regardless of whether the 02 malfunction, loss, or other situation occurred within or without the waters of the state. 03  (b) A person in charge of a tank vessel shall certify upon docking or landing 04 the vessel within the state that the vessel from the time of its last docking or landing 05 has not, while within 200 miles of the baseline from which the territorial sea of the 06 state is measured, suffered a steering malfunction, loss of power, or other situation that 07 significantly affected the seaworthiness of the vessel that was not repaired or corrected 08 within 60 minutes of the malfunction, loss, or other situation without the person in 09 charge of the tank vessel informing the United States Coast Guard and appropriate 10 state authorities of the malfunction, loss, or other situation. A certification under this 11 subsection shall be on a form provided by the department that bears a notice that a 12 false statement made in the certification is punishable under AS 11.56.210. 13  (c) This section does not prevent a person in charge of a vessel subject to this 14 section from notifying the United States Coast Guard and appropriate state authorities 15 within the first 60 minutes after a malfunction, loss, or other situation occurs. 16 * Sec. 2. AS 46.03.744 is amended to read: 17  Sec. 46.03.744. DEFINITIONS. In AS 46.03.741 - 46.03.744 [AS 46.03.742 - 18 46.03.744], 19  (1) "hazardous substance" has the meaning given in AS 46.03.826; 20  (2) "tank vessel" means 21  (A) a vessel that is constructed or adapted to carry, or that 22 carries, as a means of transportation by water, a hazardous substance in bulk 23 as cargo or cargo residue; 24  (B) the vessel that propels the tank vessel if the tank vessel is 25 a barge or other vessel that is not self-propelled. 26 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
