SSHJR 26: Proposing amendments to the Constitution of the State of Alaska relating to the individual right to keep and bear arms and to the misuse of arms.

00SPONSOR SUBSTITUTE FOR HOUSE JOINT RESOLUTION NO. 26 01 Proposing amendments to the Constitution of the State of Alaska relating to the 02 individual right to keep and bear arms and to the misuse of arms. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article I, sec. 19, Constitution of the State of Alaska, is amended to read: 05  SECTION 19. RIGHT TO KEEP AND BEAR ARMS. (a) A well-regulated 06 militia being necessary to the security of a free state, the right of the people to keep 07 and bear arms shall not be infringed. Except as provided by (b) of this section, the 08 individual right to keep and bear arms shall not be denied or infringed by the 09 State or a political subdivision of the State. 10 * Sec. 2. Article I, sec. 19, Constitution of the State of Alaska, is amended by adding a 11 new subsection to read: 12  (b) The legislature may define and punish by law the misuse of arms. 13 * Sec. 3. Article XV, Constitution of the State of Alaska, is amended by adding a new 14 section to read:

01  SECTION 29. EFFECT OF 1994 AMENDMENT OF SECTION 19 OF 02 ARTICLE I. The 1994 amendment of Section 19 of Article I does not affect or 03 change any law relating to misuse of arms that is in effect on the date of ratification 04 of the 1994 amendment of that section. These laws shall continue in force until they 05 are amended or repealed by law and, while the laws remain in effect, any interpretation 06 of them that was made by a court before the effective date of ratification of the 1994 07 amendment remains in effect until revised by a court. 08 * Sec. 4. The amendments proposed by this resolution shall be placed before the voters of 09 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 10 State of Alaska, and the election laws of the state.
