00HOUSE BILL NO. 483 01 "An Act relating to payment of permanent fund dividends of certain individuals 02 who have been absent from the state; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 43.23 is amended by adding a new section to read: 05 Sec. 43.23.017. DIVIDENDS OF CERTAIN INDIVIDUALS WHO HAVE 06 BEEN ABSENT. (a) An individual who is eligible for a permanent fund dividend 07 and has been absent from the state for at least six consecutive months during the 12-month period immediately 08 preceding the date of application for that dividend may not 09 receive the dividend until the individual has 10 (1) been physically present in the state for a consecutive 12-month 11 period, except that during that period the individual may have been absent for up to 12 30 days; and 13 (2) after satisfying the requirement of (1) of this subsection, filed a 14 request for receipt of the prior year dividend with the department.
01 (b) If, before receiving the prior year dividend, an individual who is eligible 02 to receive a prior year dividend under (a) of this section fails to apply or qualify for 03 a dividend for a subsequent year, that individual becomes ineligible to receive the prior 04 year dividend. 05 (c) If an individual who is eligible for a dividend but has not received it dies 06 before satisfying the requirements of (a)(1) and (2) of this section, the department shall 07 pay the dividend to the appropriate person on behalf of the estate of the individual. 08 (d) The department shall prescribe and furnish a form for requesting receipt 09 of a dividend under (a) of this section. 10 * Sec. 2. This Act takes effect January 1, 1995.
