00CS FOR HOUSE BILL NO. 371(FIN) am 01 "An Act making appropriations to capitalize the mental health trust fund from 02 the balance of the mental health trust income account on June 30, 1995, mental 03 health trust income of the Department of Natural Resources in the general fund, 04 and earnings reserve account; making an appropriation to the mental health trust 05 income account from the net income earned by the mental health trust fund; and 06 providing for an effective date." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. (a) The sum of $200,000,000 is appropriated to the mental health trust fund 09 (AS 37.14.031), added by sec. 11, ch. 66, SLA 1991, from the following sources, in the 10 amounts listed, to capitalize the mental health trust fund: 11 SOURCE APPROPRIATION 12 Mental health trust income account $ 32,200,000 13 (AS 37.14.011) balance on 6/30/95 14 Department of Natural Resources - mental health 11,957,100
01 trust income in the general fund 02 Earnings reserve account (AS 37.13.145) 155,842,900 03 (b) The net income earned by the mental health trust fund (AS 37.14.031), added by 04 sec. 11, ch. 66, SLA 1991, is appropriated to the mental health trust income account 05 (AS 37.14.011) for uses authorized in AS 37.14.041. 06 (c) The appropriations made by (a) and (b) of this section are contingent upon 07 (1) the enactment into law of a bill passed by the Eighteenth Alaska State 08 Legislature that amends ch. 66, SLA 1991, and contains other provisions relating to the mental 09 health land trust and mental health land trust litigation (Weiss v. State, 4FA-82-2208 Civil); 10 and 11 (2) not later than December 15, 1994, 12 (A) the superior court of the State of Alaska having made a final 13 determination that the state has satisfied its obligation to reconstitute the mental health 14 trust under State v. Weiss, 706 P.2d 681 (Alaska 1985); 15 (B) the superior court having entered a final order dismissing Weiss v. 16 State, 4FA-82-2208 Civil; and 17 (C) the time for appeals of that determination and that order having 18 expired with no appeals having been taken. 19 (d) If, on or before November 30, 1994, the Governor determines that it is in the best 20 interest of the beneficiaries of the mental health trust and the state that the December 15, 1994 21 deadline in (c)(2) of this section be extended, the Governor at that time may extend the 22 December 15, 1994 deadline for not more than forty-five days. 23 (e) The appropriations made by (a) and (b) of this section are for the capitalization 24 of funds and do not lapse. 25 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
