00HOUSE BILL NO. 333 01 "An Act amending the Alaska Land Act to define the term `state selected land' 02 for the purpose of recognizing mining locations, and giving retrospective effect to 03 the amendment; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 38.05.275 is amended to read: 06  Sec. 38.05.275. RECOGNITION OF LOCATIONS. Mining locations made 07 on state land, including shoreland, tideland, or submerged land, or state selected land, 08 under AS 38.05.185 - 38.05.275 or in the manner described in AS 27.10, acquire for 09 the locator mining rights under AS 38.05.185 - 38.05.275, subject to existing claims 10 and to any denial of or restriction in the tentative approval of state selection or patent 11 of the land to the state. If shoreland, tideland, or submerged land is included in a 12 mining location or within the projected boundaries of a mining location made in 13 accordance with this section, the locator shall record a certificate of location under 14 AS 38.05.195. The certificate of location must identify the position of the mining

01 location in the system of rectangular or protracted surveys. If the mining location is 02 made in the manner described in AS 27.10, the commissioner may require that the 03 locator amend the mining location to conform with AS 38.05.185 - 38.05.275 and 04 thereafter to comply with the requirements of AS 38.05.185 - 38.05.275. In this 05 section, "state selected land" means land that has been selected by the state under 06 Sec. 6 of the Alaska Statehood Act, as amended, as to which the state has filed a 07 selection application with the United States, regardless of the validity or effect of 08 the application, and the application has not been denied. 09 * Sec. 2. AS 38.05.275, amended by sec. 1 of this Act, is retroactive to April 14, 1966, 10 and applies to certificates of location filed under AS 27.10.050 on and after that date. 11 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
