00HOUSE BILL NO. 325 01 "An Act relating to motorcycle safety and to use of helmets by operators of 02 motorcycles." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. POLICY. It is the policy of the state that the state highway safety program 05 include a motorcycle safety program. 06 * Sec. 2. AS 28.35.245 is repealed and reenacted to read: 07 Sec. 28.35.245. MOTORCYCLE HELMET. (a) A motorcycle helmet may not 08 be manufactured or sold in the state unless the helmet conforms to standards 09 established by regulation by the commissioner of public safety. The regulations must 10 provide for helmets that allow normal peripheral vision and hearing and minimize neck 11 injuries to the wearer potentially caused by the helmet. The regulations shall be 12 adopted under the provisions of AS 44.62 (Administrative Procedure Act). 13 (b) A person who is 18 years of age or older may not be required to wear a 14 helmet while operating a motorcycle if the person is the holder of a license or
01 endorsement to operate a motorcycle. 02 * Sec. 3. AS 44.42.020(a) is amended by adding a new paragraph to read: 03 (16) establish and implement a motorcycle safety program as a part of 04 the state highway safety program.
