00HOUSE BILL NO. 313 01 "An Act relating to suspended imposition of criminal sentences and to the period 02 in which suspension of the imposition of sentence for conviction of the crime of 03 disorderly conduct may be authorized." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 11.61.110(c) is amended to read: 06  (c) Disorderly conduct is a class B misdemeanor and is punishable as 07 authorized in AS 12.55 except that 08  (1) a sentence of imprisonment, if imposed, shall be for a definite term 09 of not more than 10 days; and 10  (2) if imposition of a sentence of imprisonment is suspended under 11 AS 12.55.085, the period for which the imposition of the sentence may be 12 suspended may not exceed 90 days. 13 * Sec. 2. AS 12.55.085(a) is amended to read: 14  (a) Except as provided in (f) of this section, if it appears that there are

01 circumstances in mitigation of the punishment, or that the ends of justice will be 02 served, the court may, in its discretion, suspend the imposition of sentence and may 03 direct that the suspension continue for a period of time [, NOT EXCEEDING THE 04 MAXIMUM TERM OF SENTENCE THAT MAY BE IMPOSED,] and upon the terms 05 and conditions that the court determines, and shall place the person on probation, under 06 the charge and supervision of the probation officer of the court during the suspension. 07 If the court orders suspension of imposition of sentence under this subsection, the 08 period of suspension that the court may order may not exceed the longer of: 09  (1) the maximum term of the sentence that may be imposed; or 10  (2) the maximum period for which imposition of sentence may be 11 suspended if the legislature has authorized a period of suspension of imposition 12 of sentence that is greater than the maximum term of the sentence that may be 13 imposed. 14 * Sec. 3. APPLICABILITY. AS 11.61.110(c)(2) and AS 12.55.085(a)(2), enacted by this 15 Act, apply to suspension of imposition of criminal sentences for crimes committed on or after 16 the effective date of this Act.
