00SENATE CS FOR CS FOR HOUSE BILL NO. 266(RES) 01 "An Act relating to guide-outfitter and master guide-outfitter licenses; extending 02 the termination date of the Big Game Commercial Services Board; and providing 03 for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 08.03.010(c)(5) is amended to read: 06  (5) Big Game Commercial Services Board (AS 08.54.300) -- June 30, 07 1994 [1993]; 08 * Sec. 2. AS 08.54.350(a) is amended to read: 09  (a) A natural person is entitled to a guide-outfitter license if the person 10  (1) is 21 years of age or older; 11  (2) has practical field experience in the handling of firearms, hunting, 12 judging trophies, field preparation of meat and trophies, first aid, photography, and 13 related guide-outfitting activities; 14  (3) is familiar with the terrain and transportation problems in the game

01 management unit for which the license is requested; 02  (4) has passed the qualification examinations prepared and administered 03 by the board; 04  (5) has demonstrated to the board sufficient standards of competence 05 and ethical conduct and has not been convicted of a state or federal hunting or 06 guide-outfitting statute or regulation within the last five years for which the person was 07 fined more than $500 or imprisoned for more than five days; 08  (6) has legally hunted in the state for part of each of any five years in 09 a manner directly contributing to the person's experience and competency as a 10 guide-outfitter; 11  (7) has been licensed as and performed the services of a class-A 12 assistant guide-outfitter or assistant guide-outfitter in the state for a part of each of 13 three years, or has guide-outfitted in the state for a part of each of three years under 14 a marine mammal guide-outfitter license issued under AS 08.54.360; 15  (8) has demonstrated a current knowledge of fishing, hunting, and 16 guide-outfitting regulations; 17  (9) is capable of performing the essential duties associated with 18 guide-outfitting; 19  (10) has been favorably recommended in writing by eight [SIX] big 20 game hunters, at least two for each year of the person's most recent three years as a 21 class-A assistant guide-outfitter or assistant guide-outfitter, when the person has 22 guide-outfitted or assisted in guide-outfitting as a class-A assistant guide-outfitter or 23 assistant guide-outfitter, whose recommendations have been solicited by the board from 24 a list provided by the applicant; 25  (11) possesses a business license to provide guide-outfitting services; 26 and 27  (12) has paid the license fee and commercial use permit fee. 28 * Sec. 3. AS 08.54.350(b) is repealed and reenacted to read: 29  (b) A master guide-outfitter license authorizes the licensee to use the title 30 master guide-outfitter, but is for all other purposes under this chapter a guide-outfitter 31 license. A natural person is entitled to receive a renewable master guide-outfitter

01 license if 02  (1) the person 03  (A) is, at the time of application for a master guide-outfitter 04 license, licensed as a guide-outfitter under this section; 05  (B) has not been convicted of a state or federal hunting or 06 guide-outfitting statute or regulation within the last five years for which the 07 person was fined more than $500 or imprisoned for more than five days; 08  (C) has been licensed in this state as a guide-outfitter or a 09 guide, under the former AS 08.54.010 - 08.54.240, for at least 12 of the last 15 10 years, including the year immediately preceding the year in which the person 11 applies for a master guide-outfitter license; 12  (D) submits a list to the board of at least 25 clients whom the 13 person has personally guide-outfitted or guided and receives a favorable 14 evaluation from 10 of the clients selected from the list by the board; and 15  (E) pays the application fee, if any; or 16  (2) the person 17  (A) received a master guide-outfitter license under sec. 13, 18 ch. 37, SLA 1989; 19  (B) has annually renewed the license; and 20  (C) has not had the license 21  (i) revoked or suspended; or 22  (ii) lapse under AS 08.54.440. 23 * Sec. 4. AS 08.54.395(a) is amended to read: 24  (a) A [GUIDE-OUTFITTER OR] marine mammal guide-outfitter, while 25 engaged in providing big game commercial hunting services, shall carry, as a 26 minimum, comprehensive general liability insurance of $300,000 per occurrence or 27 $500,000 per annual aggregate or post a financial bond in those amounts. 28 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
