00HOUSE BILL NO. 247 01 "An Act changing the frequency of certain state inspections of weights and 02 measures and relating to the issuance of citations for weights and measures 03 violations." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 45.75.080(a) is amended to read: 06  (a) The director may inspect and test, to ascertain if they are correct, all 07 weights and measures kept, offered, or exposed for sale. The director shall, at least 08 annually [SEMIANNUALLY] and more often as considered necessary, inspect and 09 test, to ascertain if they are correct, all weights and measures commercially used in 10  (1) determining the weight, measurement, or count of commodities or 11 things sold, or offered or exposed for sale, on the basis of weight or of measure; 12  (2) computing the basic charge or payment for services rendered on the 13 basis of weight or of measure or count; or 14  (3) determining weight or measurement when a charge is made for this

01 determination. 02 * Sec. 2. AS 45.75.131(a) is amended to read: 03  (a) A peace officer or an employee of the Department of Commerce and 04 Economic Development who is authorized by the commissioner of commerce and 05 economic development to enforce this chapter [THE SIZE, WEIGHT, AND LOAD 06 LIMITATIONS ADOPTED BY THE DEPARTMENT OF TRANSPORTATION AND 07 PUBLIC FACILITIES UNDER AS 19.10.060] may issue a citation to a person who 08 [VIOLATES] 09  (1) violates a weight, size, or load limitation adopted by the 10 Department of Transportation and Public Facilities under AS 19.10.060; 11  (2) violates the terms of an overweight or oversize vehicle permit 12 issued under AS 44.33.020(25); [OR] 13  (3) violates a regulation adopted under AS 28.05.011(2) or under 14 AS 44.33.020(25) and AS 45.75.050(b)(5); or 15  (4) commits a violation identified under AS 45.75.380.
