HB 169: "An Act relating to milk." 

00HOUSE BILL NO. 169                                                                                                      
01 "An Act relating to milk."                                                                                              
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 03.05.020(b) is amended to read:                                                                    
04  (b)  In this section,                                                                                                 
05   (1)  "commissioner" means the commissioner of environmental                                                        
06 conservation;                                                                                                          
07   (2)  "milk" includes milk that has not been pasteurized.                                                            
08    * Sec. 2.  AS 03.17.100 is amended by adding a new paragraph to read:                                                
09   (5)  "milk" includes milk that has not been pasteurized.                                                             
10    * Sec. 3.  AS 03.17 is amended by adding a new section to read:                                                      
11 ARTICLE 2.  SALE OF RAW MILK.                                                                                           
12  Sec. 03.17.200.  SALE OF RAW MILK.  (a)  A person may sell goat or cow                                                
13 milk that has not been pasteurized.  The sale shall comply with the conditions                                          
14 established by the commissioner of environmental conservation under AS 03.05.020(a),                                    



01 including the minimum standards established for grade A pasteurized milk.                                               
02  (b)  Notwithstanding AS 03.17.090, a person who violates (a) of this section                                          
03 is guilty of a class B misdemeanor.
